In fact, I would say they have as much a case for claiming overpayment as your daughter would have if she was claiming underpayment (i.e. none).
I agree ! Our defence is that my Daughter has never received notification of her rate of pay and so could never have been expected to know that she was being overpaid. The loopy one has gone :j0 -

I was trying to find out WHO actually printed the incorrect date of birth on the P60.
But you didn't ask who printed the P60's in your OP, did you?
If I were you I would act dumb and ring up and ask for a copy of your daughter's contract of employment as she is entitled to one after 13 weeks of employment.
In the contract there may be something like "your rate of pay is stated on your payslip and you will be paid weekly/monthly".
I do find it very odd that your daughter didn't ask what her rate of pay would be on getting the job. I understand she is happy to have a job that fits in with her studies but rate of pay would be my first question as a teenager as I'd want to plan what I was going to spend all that money on.Freebies Received: Supersavvyme bag, Olay moisturiser, Barbara Daly/Tesco Mascara, Seeds of Change Choccie, Yorkshire Tea Kenyan teabags, Tesco mobile sim cards x 2.

My Daughter has just arrived home from work with her P60 , her first ever as she is in her first job.
I ran my eye over it to check that everything was correct and have noticed that her date of birth is incorrect on it.
Now , I will probably ring her head office tomorrow but in the meantime does anyone know if it would be the head office I would need to inform or would it be HMRC?
How do you work out that I didnt ask whether it should be the employer or HMRC whom I should contact? The loopy one has gone :j0 -

Seems my Daughter isnt like you then

Also , if you re-read my previous posts you will see that I stated that the rates of pay were never discussed or put down in writing.
So, it is an assumption that the pay is age-related and not known for certain.
The entitlement to written particulars of employment is for them to be provided within two months of the start of employment. (I may have missed your statement that she has worked there for more than 13 weeks but otherwise silverjay's post suggests the employer is allowed 13 weeks to provide the details when in fact it is two months.)0 -

The only reason we *think* pay is age related is that my Daughter asked another girl who works with her , who is also 17 years old , what rate of pay she is on and the girl has told her that she is on £4.65 per hour (which is actually over the national minimum rate for this age group) This means that she may not have received as much of an over payment as we first thought.

See , I knew this , however as there havent really been any major issues in the employment so far we just never asked for it to be issued to our Daughter. (Daughter didnt even know this document existed and so that is why she never asked for it herself)

She started working there in very early September of last year so approx 7 months. The loopy one has gone :j0 -
Does your daughter and her friend do exactly the same job ?
If they don't perhaps that's why they have different pay ( just a thought )
Also got to say a bit worrying if you thought the P60 was printed by HMRC.0 -

Whys that then? Are you trying to say that everyone should know everything about EVERYTHING?
Smart ar-se comments are not really what I am looking for on the thread thanks. The fact that I wasnt sure who prints P60 isnt actually relevant to the thread now is it?
Fortunately I have received excellent comments from the posters previous so if you have nothing relevant to add I would be greatful if you could save the un-neccessary comments...they are neither needed nor appreciated! The loopy one has gone :j0 -
U P D A T E :
Well , my Daughter has just come home and telephoned her employers Head Office to inform them of the incorrect Date of birth.
The problem has now been rectified.
She explained the situation to the (very helpful) Lady on the phone and the lady said let me just check that for you..the line went silent for a second and then the lady came back on the line and said "the date of birth we hold on your file is **/**/1993 (the call was on loud speaker so I could hear and prompt my DD if she needed to ask any questions).
At this point I let out a sigh of relief :rotfl:.
My Daughter then pointed out that the date on the P60 was **/**/1990 to which the lady assured her that it was merely a typing error by who ever had filled in the P60 details but that the date of birth on her personell file is definately correct.
phew ! It seems that there is no over payment after all.
The lady also said that she get a letter sent off to HMRC to inform them that the incorrect DOB was put on the original P60 and ask should another one be issued and she says that she will forward a copy of this letter to my Daughter for her records.
Problem sorted.
Again , a massive thanks to all who advised on the thread. The loopy one has gone :j0 -
Also got to say a bit worrying if you thought the P60 was printed by HMRC.
I honestly meant it in a kind way, if I hadn't I would have phrased it totally differently
. I think it would be good if , when someone starts their first job, to have some kind of leaflet to let them know the basics of paye, about tax codes, forms etc. Just to let them know what to expect, what their rights are etc. 0
