in prison on remand would they be able to go to a grandparets funeral

Would someone who is in prison on remamd be able to go to their grandparents funeral, if they could would there be someone with them from the prison.

    Depends on whether they would be likely to abscond, self harm or commit other crimes and how serious the crime is they are on remand for.

    My cousin was not allowed to go to a family funeral when in for armed robbery (he had a syringe not a gun.. not that it is ever ok)

  • They need to speak to their lawyer about making an application to Court to be able to go. The Prosecution would also need to see if they had any objections.

    I think its judged on individual circumstances hun - by either the prison governer or the court.

    And there almost certainly will be someone from the prison with them and they may be handcuffed.

    AFAIK it is the Governor who has to decide, and if it is granted (which isn't a given, depending on what the person is on remand for) then again AFAIK they will handcuff the prisoner and (obviously) at least one guard will be with them at all times. Although they may put a coat or something over the cuffs for a bit of dignity. I'm also wondering whether the prison authorities wouldn't consider a grandparent to be such an important funeral to attend as say a parent or a child when weighing up the risk of letting the prisoner go to the funeral.

    Usually, yes.

    A person 'on remand' hasn't been to trial, hasn't been found guilty and isn't serving a sentence. A grandparent is considered to be 'close family'. There would have to be proof of the relationship.

    There are exceptions ( grandparent lives abroad; no contact with grandparent for umpteen years; not possible after risk assessment etc).
  • Thankyou for your replys, the person that i am asking about did actually apear in court for threatening to kill his grandmother that has died this was 5yrs ago, he was on remand untill the trial then was let off because ther was not witnesses at the time he was threatening to kill her. He is now in prison for stabbing a partner and on trial next month.

    What do the rest of the family think about him attending the funeral?
    Did the Grandmother forgive him?
    In the circumstances you describe above, I'm pretty sure that if I were a close relative of the deceased (maybe daughter, grand-daughter) I wouldn't want him there unless there had been a reconciliation.

    Oh Mercedes - are you from the family and terrified this nutter is going to turn up?

    I'm sure he can apply to come, but it won't be automatic, and with it being such a violent crime, that must effect the decision.

    You could contact the governors office at the prison and let your feelings known about his attendance, or find out if there is an official way you can appeal against his being released from it.
