Unpaid for laptop

Hello all. I hope I am posting in the right section of the forum, please move if I'm not.

My problem is I ordered a custom built PC from one of the large computer companies and it is being delivered without having been paid for.

I paid by debit card and the money was 'taken' from my account but it wasn't claimed in time by the company I'm buying my PC from, so the money went back into my account. I thought there was a problem with something and I would just go an order a PC from somewhere else.

Anyway, the PC has shipped and is on it's way to me. The place I bought it from have sent me an invoice via email saying it is paid for.

What should I do, and could I be held liable to pay for it in the future if I choose not to return it?

I'm not looking for lectures on morals, just advice from a legal standpoint.

Cheers. :)

Yes! You will be liable for full payment. If you still want the PC then pay for it, if not, contact the company and ask for them to pick it up.

They have 6years to claim the money back.

I don't follow the "money was taken but not claimed in time so went back into your account" bit.

The bank authorised the payment for the company to collect the money but they failed to do so. If the money isn't collected within a certain time it goes back into the account. I'm not 100% sure on how the banking system works in the UK but it is something like that.

    @ Foggster

    Thanks for the info.

Can you do that for custom made items?

The money may have gone back into the account, and they may have failed to collect, but the debt is still owed of course - you have their lappy, they don't have your cash. Easiest is to give them a quick call and ask what they want to do, it may save somebody's job, or a heap of stress at the year end at least ;-)

Reggie you will be back on here in 1,2,3,4,5 or 6 years !!!!!ing because they're rightfully chasing their money...you perhaps will need a loan/mortgage at that time..and you will be screwed. You have the choice and can sort it now.

    Of course you can.
You can ask what you like.

Whether they will collect or not, is another question. :D

Say what? It's not a credit agreement, they can't add anything to my credit report even if I didn't send it back.

I wouldn't think there is a lot they can do if I phone them and explain the situation, then tell them that I want them to pay the return shipping costs.. They can't really say no if they want the laptop back. I doubt taking me to small claims court would be worth the hassle.

The other option would be to keep it unopened for a month. Then use it and IF they do realise their mistake I could just pay for it... I guess..

You are deluded....why do you think you can keep it unopened for a month and then use it?

Well I just mean that if they are going to realise their mistake it will most likely be soon after shipping and then the chances of them finding out after will be a lot slimmer. So if I kept it unopened for a month, I would still have the option of sending it back.
