three mobile

I telephoned 3 to cancel my phone contract, as i could no longer afford the amount it was costing each month, well they offered me an upgrade and a cheaper package, they sent me a phone out which i did not like as it had no flash, so i rang them up and they said how bout we send you the htc wildfire instead it has a flash, i said ok, i will try that one then, well it arrived and i hate it, as its touchscreen, i was never told this, well i rang them and they said sorry you cant send it back, you are only allowed to change one upgrade, well i was not happy as i was not told this, i asked to speak to a manager, who rang me back, he would not allow me to cancel my upgrade, i was trying to explain to him that i was not told that i could not send this one back, all he kept going on about is it says on the screen in front of me that you was told you could not send this back, i told him i was not told this, well the paperwork that came with the phone says their returns policy is 14 days, and it states nothing on there about only being allowed one change of an upgrade phone, when i told them this he said that paperwork goes out with every phone, i asked him where is the terms of the only one upgrade phone allowed, as i had not received anything, he kept saying its a new policy that has come in, im really stuck now as im locked in another contract for 2 years with a phone i personally cant use, i feel i have really been conned by three, somebody help me please.

    So, did you assume that you can keep sending the phones back infinitely? Very strange assumption.

    No flash? Beggars cannot be choosers. Especially lazy beggars.

    Is it that hard to find some information in the internet before agreeing to a new handset? Even while being on the phone with '3' it takes seconds just to type 'wildfire' into Google search an you have to be blind not to notice that it's touch screen.

    Is it that difficult to check the returns policy at least after sending the first phone back?

    If you bought your mobile online or via telesales:

    If you’re a new customer who purchased your mobile via three.co.uk or from our own telesales team and for some reason you change your mind, provided you have not used your mobile, you can return it within 14 days of delivery. You'll also have to return the original boxed accessories and documentation ‘as new’.
    This policy doesn’t apply:
    • to new customers who did not purchase their mobile via 3's telesales team or via three.co.uk
    • to new customers who purchased their mobile via 3's telesales team who have used their mobile (this means that you may not personalise your mobile in any way, or use any of the 3 Services, or take photos or videos or load any data onto the mobile), or
    • to existing customers who choose (where allowed by 3) to upgrade their mobile.
    I guess the paperwork says the same somewhere.
    You were lucky to have it exchanged first time.

    If you don't like the phone sell it on ebay and buy something that you like instead.

    i would like to point out that i did not have access to the internet, so i could not look at the phones beforehand, and i could not look up the returns policy on line either, they knew this, when i agreed to have the wildfire sent to me, the customer service person told me the terms and conditions are the same as last time, he did not mention i could not send it back, and im not really a phones person, so i dont know which phones are touch screen and which aint, and i would like to point out that they did not read me the returns policy over the phone, which apparantly they are saying they did, if it comes to it then i will sell the phone, and as soon as my contract ends i will leave three, have to say they are very rude over the phone aswell, the bloke was shouting at me, when i was trying to explain things to him, he was the manager aswell, he then hung up on me.:(

    Thats your problem. There are these things called shops. Even Tesco have mobile phones in their shops. You can go look at them.

    Doesn't say has no access, just not at the time.

    I never call 3 without being in front of a PC, take plenty of notes, and NEVER say yes to their first offer... even when they change their tune to say "there is another deal that is available". Tell them you'll call back once you've had a think.

    Think you guys are being a little harsh here: not everyone knows the in's and outs of how catch-22 a contract can be, yes the OP could have used a little prethought but he/she doesn't sound like they acted in order to scam three!

    OP, I don't have any answers for you, once you insert the sim the handset is yours, cannot be returned and your only options are to sell it on to someone else, buy a cheaper model or to learn how to use it and live with it, from what I hear its not a bad handset.

    If you have not opened the box, turned it on with the sim in, I'd say keep calling three and keep asking if there is anything they can do, it could be a waste of your time but if you feel so strongly about the handset that you really can't stand it, I'd be calling and trying, if only to let off steam!!

    My son didn't know what Blackberry he wanted so we went to a CPW shop and played with them. The sales man let him have a go on his.

    Granted he should have done research but you assume the OP is as clued up as the rest of us on here, he/she may have assumed they were able to have countless refunds, no its not right, I know that, you know that, but put this another way: you buy a pair of trainers online, get them delivered, decide you don't like them, exchange for another pair, decide you don't like that pair...now for most retailers I know, countless refunds and exchanges are allowed, I've never heard any clamp down, yet with mobiles its different.

    Its just one way of looking at it, yes the OP should have done research but having been with 3 myself I've had them say to me in the past "if you hang up now we wont have the same deal when we call you back". Its a lie and you should never feel pushed into anything but 3 don't seem to understand anything other then bonus targits and seem to do anything to get them acheived. I'm not saying if this did/didn't happen but with 3, nothing suprizes me.

    Look, I see where your coming from, there were obvious errors the OP made, I can see that, but having a go at someone isn't really resolving the problem he/she asked for help with is it?
