Debt reclaim
Hi,
I hope someone can help me! I have had a letter from the mobile network "3" trying to recover debts I apparently owe from 5 years ago. I have moved since then, which they say is the reason why I have heard nothing from them until this letter which has reached my new address...
The amount is £100, which is not massive but still considerable. They say it is for the premature termination of the contract. I do not remember doing this and don't think I would have done it at the risk of incurring this £100 bill. However, I no longer have my contract from back then so would realistically have no way of proving it.
They now say I need to pay the debt recovery agency. Obviously I am reluctant to pay anyone, especially for something I don't remember doing, but I will obviously pay up if the alternative is getting blacklisted! Can anyone advise me on my legal rights?

The onus lies with them to prove that you owe them. '3' had to supply the debt collection company with the proofs when selling the debt. You have a right to ask the company to supply you with the proofs....However, I no longer have my contract from back then so would realistically have no way of proving it.
If they cannot prove this, it is worth checking your credit files. They are likely to have 'default' records and you may try demanding the records to be removed by '3'.0
