False Ipad gift claim on Buymobilephones.net

Hi guys,

I need your advice quickly. Thanks in advance!

Story goes as:
I ordered a a phones which entitle me an Ipad 32GB on buymobilephones.net and a receipt email confims all the details
I then received the phone & a gift claim voucher which printed the exact ipad model above.
After sending my claim & being confirmed that my claim is ok, I called them to check when I could receive the ipad. The staff who answer me said I would actually be received a Tom Tom SatNav which £300 worth less than my expected gift. When I told her all previous information confirming that I must get an Ipad, she told me I should forget about it and accept it is a misprint. I am very !!!!ed off and hang up.

I log in my online account with buymobilephones.net and still there the gift that I am entitled to: Ipad 32GB status: claim ok

The main reason I sign up the contract is to get my ipad. So i hope someone knows what I can do to fight back. I am sure they are trying to change gift status in my account and sending the stupid Satnav as soon as they can.

    How long is cooling off period?

    If it's too late, then collect as much evidence as possible (including screenshots) and go to https://www.moneyclaim.gov.uk/web/mcol/welcome

    If everything you posted was true, I think they don't have a leg to stand on.

    Do they have a 'get out clause' anywhere saying something like, 'While stocks last' or 'Subject to availability' ??

    Hi Jon, i read the T&C before and as far as I know there is only a delay in delivery subject to avaiability. Today I look up the T&C again and see this line:

    "If the free gift that was offered with your purchase is discontinued or is unavailable for us to source for any other reason, we reserve the right to offer an alternative and equivalent product or package, or the market value value of the product in cash."

    Even it is the case, I don't see why they offer me the cheapest alternative (£300£ worth less). More importantly, they ddidn't say it is their alternative offer but simply state that it is a misprint.

    It is more than 7 days of distance selling return. So it seems that I have to collect evidence and report them. now if they decide to send the Satnav, I don't know If I should refuse it

    Get a Screen grab of this and a hard print-off before it changes.

    If it's a misprint - why do they still advertise that you can have an IPAD2 on their website?

    so you can show that even after they told you it was a misprint or any other excuse about supply, they were still offering it on their website.

    Make sure you log all communications with them. This looks to me to be a straight forward bait and switch con.
