£70 Breville kettle dead after 18 months.

Just contacted Littlewoods catalogue about the kettle I bought in november 2009. I noticed a burning electric smell in kitchen and then noticed later the kettle wouldnt work. Its one of those colour changing spectre Breville models in steel. They asked me to try manufactureres but the website says guaranteed for only a year whats are my rights under fit for purpose, can anyone help?

You would have to get an engineers report to prove it was unfit for purpose. It's worth doing a little research before you contact them to see if there are reported faults with them. Contact breville and see what they say.

You would need to get an engineers report to prove the fault was there from manufacturing and therefore inherent and not damaged through misuse.

Not sure why you think it's unfit for purpose ? I assume it has been working perfectly at least 2 - 3 times a day for the last 18 months ?

General wear and tear would not count. Heating elements do fail occasionally you know - even on the most expensive brands.

  • As has been stated the SOGA states you would need to get an engineers report.

The best thing to do, however, is to contact the manufacturer. Some will replace it (out of warranty or not). It is worth a try.

Breville didnt want to know yesterday , Littlewoods are getting back in touch within 24 hours, I said that I thought 15 months of use on a £70 kettle wasnt good enough, did check the fuse though and still dead.Fingers crossed.

After waiting for my return phonecall that didn't arrive in 48 hours as promised, I rang them. After speaking to customer NOT service at Littlewoods who didn't want to know about any consumer rights regarding lack of use and poor quality of my £70 kettle I decided to not give them any more of my hard earned money and shut my account down after 18 years.I am going to still send them an electrical engineers report about it but this is more expense. What shocks me most is the utmost contempt the customer service team have for their customers no apology for failing to call , firstly giving misadvice out about it was up to manufacturer. I hope they remember that without customers they wouldn't have a job and if they carry on treating people like this the company will surely go down the nick with the recession.Anyone who can recommend a catalogue who have god service and are not part of the Shop direct group I would be grateful .

As mentioned previously - after 6 months the onus is on you to prove the fault was inherent at time of manufacture and not down to misuse or general wear and tear.

    You can either
    a) Spend more time and money on an engineers report and hope for a result, or
    b) Spend more time and money on a small claims court action claiming it was unfit for purpose(?), or
    c) save the money and take it to a local electrical shop to get a new heating element fitted (Assuming that is what the fault is), or
    d) save the money and put it towards a new kettle.

Fuses should never blow these days, if they do there's a serious problem.
