PCN at my house?

    Went to the council, had to talk to a woman on the phone. When I mentioned traffic order, she started asking for my PCN number a few times - I didn't even have the PCN with me and wasn't going to give her the number even if I did. I told her the road name though.

    She then spouted some gibbersh stuff at me, names of documents and regulations and whatnot, I didn't really know what she was talking about. She was saying about the council sorting it out their end after I submitted the appeal to which I stated I wanted to look at it my end before submission. Finally got to the point where she said about boundaries, and I said that's what I wanted, said I would get it delivered that afternoon most likely (to my work address, only a few minutes walk from council).

    Didn't get it that afternoon or today. Are they giving me the run around?

    Yep.

    Ring them, email them and tell them about their 'statutory failure' and that they have an hour to provide the Traffic Order or you will be in touch with their Legal Compliance Dept.

    Well, long story short, I got the traffic order. It involved a lot of to-ing and fro-ing but I brought a print out of the regulations in case they were needed.

    Unfortunately, the traffic order does infact cover the beginning of my road, which is where I was parked.

    I am still going to contest it though as I was behind the sign on my road that clearly states private parking, which is misleading if the council can enforce a part of the road behind that sign.

    Perhaps you could post a copy of, or a link to a copy of, the full order so that it can be reviewed.
    Many Orders, though not all, are badly flawed.

    Well, I think it's game over for me :(



    "I thank you for your letter dated 11th April regarding the above and have noted your comments. Please accept my apologies for the delay in responding to your correspondence.

    The vehicle was served a penalty charge notice as it was seen 'parked in a restricted street during prescribed hours' - in this case double yellow lines.

    Please find enclosed a boundary map which shows that the area where the vehicle was parked is public highway and not as you state private land. Although the sign on the entry to the road states it is a private road, the private area actually starts further down where the white sign is - which is located beyond where the vehicle was parked.

    You state that you have a permit to park in this location, however as the area is public highway and marked by double yellow lines the permit you were displaying would not be valid for this location. It is explained in detail, in the Highway Code that yellow lines aply to the carriageway, pavement and verge; sign plates are no longer required in association with double yellow lines."

    I'm very tempted to start parking at the restaurant next door if there's no spaces in my road. The customers keep parking in our road taking our spaces, so I might just return the favour till they stop doing it.

    Seems better to face getting a PPC ticket than getting a council one.

    Well did you post this on pepipoo as well? The rejection notice from the council is stage one , there are other avenues as well, and you might as well use them as you will be paying full charge if you lose, PATAS & TPT is a free adjudicator that councils must abide by

    It's your money, and if you appeal and lose you pay the same amount so it makes no difference, but most people who appeal with pepipoo actually win as there are problems either with the pcn the traffic order for that road, the signs, the bays, the road markings, the rejection letter from the council.

    As I said councils for the most part always turn down appeals as it's a game of bluff for them, you have nothing further to lose.

    Councils almost always dismiss appeals, because they can and people give in. Do you really think their reply is anything other than a tweaked template 'computer says no'? Everyone gets this response at first!

    Why not post a pic of the PCN front &back, and the rejection letter on pepipoo and ask them how to deposit the Traffic Order so they can view it?

    Show the pepipoo experts the signs as well, sounds confusing and a procedural impropriety if the Council have 'allowed' an unauthorised sign on the public highway and are using it to reject your reps!
