Im due to be discharged in the next week or so and prior to bankruptcy had accounts with nat west rbs and barclays. I had an excellent credit history and platinum cards with all. When I was made bankrupt I gave all correct details to the OR and listed all accounts. The nat west didnt have any funds in it and throughout my bankruptcy ive been receiving statements and the account is fully operable although Ive not used it. After discharge I understand the onus is NOT on me to tell nat west as I declared everything correctly to the OR. Should I jst start using the account and carry on as normal. Would I be in breach of any regulations?

dunno about the regulations but probably behind the scenes the account has been changed to a basic account, I had a couple like this, they didnt get locked down (one other did but only for a couple of days) but my cheque and OD facilities were withdrawn. I still had a credit card with Lloyds, well on paper I did but I gave the card to the OR, the bank wrote to me a few months before discharge to say my credit limit had been reduced to 1k, it had been 19k when I went BR but I didnt owe anything on it. Last month I got a letter explaining that as I hadnt used the account for so long, it was now closed??? As you have said in your previous thread, nothing much makes much sense when it comes to the banks and BR.

I'm in a similar position. I opened a Santander account shortly before going BR. The account never went overdrawn and did not have an overdraft facility. Santander were not one of my creditors. The account has a balance of 2p. It is still open and shows up in online banking. I don't have the debit card as I cut that in half and gave it to the OR as instructed, but once I'm discharged I'm planning on asking Santander for a replacement card and using the account again.

for me its all about rebuilding as i use the company debit cards for fuel etc and i dont need to borrow anything. be honest br has not affected me in the slightest. when i filed i only actually owed money to one company which was rbs. wonder if that has anything to do with it?

Natest and RBS are part of the same banking group, be careful if you do start using the Natwest account again as they may still close it.

thats why i think it was an oversight, but ultimately ive followed all procedures correctly so if they did close it they would have to send me the balance. somebody did tell me though that as long as you operated the account correctly they couldnt close it if they not done so during the period you were bankrupt.

I suspect there's a clause in the T&C's of every bank account that the bank reserve the right to close the account if they decide to do so.

why? Ive not done anything wrong and once discharged, I am no longer liable and my debts are anulled. Surely all they could do is close the account and refund any balance which I have paid in since discharge.

I think they mean just don't use it for anything "essential" for now. e.g. DD's for priority debts, money that you need for day to day living that would be a big problem of you couldn't access it for a few days.

    That sort of thing.
