eBay is giving me a rough time..

I've got a dress that stinks and is not as described and a book that was supposedly sent 12th feb and still hasn't arrived. I'm trying to work it out with the sellers through email but its like banging my head against a brick wall. This was the latest response to the non delivered book:
"book was sent second class if its not there no it's not there i dont know where it is"
Oh great, well thanks for your help there! I've asked them to make a claim through R.Mail online but they said they can't cos it wasn't sent with insurance! !!!!!!, does this person not realise that you can make a claim up to £28 without recorded/special. I've even sent them the link to the RM site.
I ask if they have the FREE COP...i've asked them 3 times, but they haven't given me an answer (Basically it means no
)
And sellers wonder why they get NEGGED! Well with attitudes like this, is it any surprise.
They say it comes in 3's god F'ing help me!

how did u pay if u paid using paypal file a claim with paypal and report them to ebay or even better tell them u will file a county court judgement against them that will get them of thier asses.

Sorry to hear about your bad experiences
I believe the intended Recipient of a missing parcel can make a claim up to £28 without recorded/special. Worth a try if you get no joy from the seller.Bargainbabe wrote:This was the latest response to the non delivered book:

Assuming you paid by cheque you don't have many options I'm afraid.
I would suggest another email to the seller possibly along the lines of that already suggested explaining that they can still make a claim with the Royal Mail (after 15 working days) even without a Certificate of Posting. It might also be worth reminding the seller that it is there responsibility to ensure the buyer gets the items.
You can also report them to ebay as a non performing seller, I'm not sure this will help in your case but I believe that it goes on their file in case they start having a lot of problems. To find this reporting place go to HELP and type in 'non performing seller' and when you get the right question up use the 'contact ebay' email on the left hand margin.
Depending on how long you have already waited the book might still be on its way as I once had a parcel take 5 weeks to reach me!

If you paid by Paypal start a chargeback against this joker. If the book turns up then you can always stop it or pay them again.

Why do you assume i paid by cheque?? I paid through Paypal and i am now making a claim. (I rarely pay for anything by cheque) I've already emailed the seller x5 times and i have got nowhere. As i've already said in my OP, i have pointed out to the seller that they can still make a claim without a COP. They are either thick as 2 short planks or plain ignorant and selfish. I've even sent them the RM link TO CLAIM ONLINE! They didn't want to know! You don't even have to wait 15 days anymore.

Oh don't you worry, i'm charge backing his !!!!!!!
I gave them every oportunity to help me and they turned around and said above.
I'm not bragging here, but i class myself as an excellent seller and i naturally compare other sellers to me. I keep my buyers informed all the way, i do everything in my power to get the item to the buyers door and on the rare occasion when things do go wrong, i refund the buyer and claim back through RM.

I think it means Certificate of Postage which the post office will stamp Free of charge to prove you posted an item to the address (though it doesn't describe what has been sent!).0 -

Spot on Dougk. No it doesn't describe what has been sent but with this you can make a claim up to £28 for a lost item that was sent by standard 1st/2nd class.
I am sick of sellers who turn around and say "its RM's responsibility to get it to your door not me". Yes this might be right to a degree, but then the seller is the one who is supposed to chase up the lost item, so effectively it is still their responsibility. It has to be the sender that makes the claim.
You know what really makes me angry? The fact that i kept my side of the bargain. I paid them straight after auction. I patiently waited, i didn't hassle the seller. I gave it 2 weeks, even though i paid via P.Pal. I didn't just neg them without contacting them first. I remained very polite in my emails (although my blood was boiling) and they effectively told me to get stuffed.
And if i neg the £$Y$*&&" he will neg me straight back and then my 100% feedback will be ruined after all my hard work.

Can't you diary it and neg him the last second after 90 days so's he can't reciprocate and ruin your feedback? Or doesn't it work like that?0
