HP Ink cartridges

we have a problem with HP and interested to know others opinions.
We have a C6180 fax / printer etc about 2 years old and have been purchasing the 363 multipack of cartridges which used to be £27.99 a pack in early days, this consists of 6 different colours.
Inks last a varying time but most run out together, and of course its cheaper to buy in bulk than individual.
This week i took a cartridge out of the draw into printer and it came up with a error cartridge out of date.
rung HP AND THEY EXPLAINED THE CARTRIDGES WERE OUT OF WARRANTY???? and that was that, we should have known because of the date on the box...
o yes we keep the boxes...
Following a lengthy conversation HP agreed thqt they would send us a 6 pack as a good will gesture, a key minutes on hold only to be told their system would not allow the order to be processed and the best that they could do was to offer us 2 cartridges to make up for the 11 that would not work. This we refused... 6 seemed a fair position to agree to.
we sent them the cartridges as they are of no use to us and today we got a email to say we didnt need to return the cartridges, as as we had refused their offer the matter was closed.
someone has suggested we try our luck in small claims court on the basis of them proving that the cartridges were fit for purpose at time of sale.

Edit your post please, in particular the paragraph starting 'They then agreed...' because at the moment I just can't pick out what, if any, point you're making there.

How long have you had the cartridges? If longer than six months, the onus is on you to prove that they are inherently faulty.Gone ... or have I?0

I could not give a exact date that we bought the cartridges that could not be used, we buy the 6 pack and put them in the draw,when one runs out we replace it,
The 6 months you refer to is that a point of law, i am aware of the principle for a part that has been used and develops a fault in the 1st 6 months but as the cartridge is refused by the printer we do not know for sure they ever worked. i was trying to think of another example of something you buy sealed and do not know if it works untill you use it and that the small print explains that the warranty is subject to their terms and conditions that can change at any time...0 -

It's stated in the Sale of goods act.
http://www.legislation.gov.uk/ukpga/1979/54For the purposes of subsection (1)(b) above goods which do not conform to the contract of sale at any time within the period of six months starting with the date on which the goods were delivered to the buyer must be taken not to have so conformed at that date.
Basically it states that if the goods become faulty at any time up to 6 months from purchase, the fault is classed as being inherent (a manufacturing defect), and it is up to the retailer to prove otherwise.
After 6 months from purchase, it is as dmg24 stated. It is then the responsibility of the purchaser to prove the fault was there from manufacture.0 -

Yep, the six month rule is written in statute. You ordered the cartridges as one item, and as you have used some of them, you will have been deemed to have accepted the goods.
You will need to find out when you bought them, but if it was recent and they are out of date I would be surprised if they were supplied by HP, as the ones they supply normally have a good shelf life. Did you buy them direct or through a reseller?Gone ... or have I?0 -

And if you are anything like me, that may come as a bit of a shock.
A number of times I've bought something, had it go wrong and been convinced that I got it "less than a year or so ago".
However, once I've dug out the receipt, I then find it was actually 2 or 3 years previously that it was purchased.

Here's how it works. The profit margin on printers is small. The profit margin on ink is much higher. So HP has a couple of ways of roping you in to forever buying their ink. 1. They've designed their printers to only accept HP-branded ink cartridges, 2. They put a pointless expiry date on the cartridges (there's nothing wrong with this ink, it doesn't go off!). We replaced ours with a continuous ink system. Take that, HP.
It works too...and in true MSE-style, it costs £44 for 250ml of every colour...which works out as over £2500 cheaper!Squirrel!If I tell you who I work for, I'm not allowed to help you.
