  • You can reject the car under the Sale of Goods Act as he didn't have title to it.

    The fact he didn't know, doesn't make a difference.

    The problem her is that OP paid cash. One suspects that the seller has now run off with the money, leaving them out of pocket.

    One supposes that those nice men with bowler hats selling wrecks outside the auction have moved to new technology.

    In thsi instance OP has my sypmathy, though I would suggest that if the dealer or seller is unknown to buyer, one should always proceed with caution. If seller wants cash, tread carefully.

    You don't have many rights when you buy privately, but the law does say the goods must match any description given, and that the seller must have the right to sell the item. You could argue for a refund based on the incorrect engine size alone, but the fact he did not have the right to sell the vehicle means the sale is invalid and your virtually guaranteed to win in court. It doesn't cost much and it's easy to do. Have a look at https://www.moneyclaim.gov.uk/web/mcol/welcome .

    Print some copies of the eBay item description for your records and write down in a diary everything that's happened so far so that you can refresh your memory before court.

    Ps. If the police believe he didn't know he was selling a stolen car, that just means he may not be charged with a criminal offence. It doesn't affect your civil claim.

    and if you do sue him, then he'll learn a valuable lesson. Check this stuff out before he buys. In not doing so he has been part of a chain that has caused no end of grief, man hours and cost. all because he didn't know or didn't care. it is your job to educate him.

    thanks for your replys guys, im going to make a small claims case against him, thanks for the link pendulum
    also will the case be heard in nottingham where i bought the car, because im from preston , and would prefer it here!

    also if i win the case will he have to pay me it all back at once, or will it be £5 a week or something like that, i really hope thats not the case,!
  • You can have the case heard at your local court - have you spoken to your local citizens advice ? They will help you fill in the forms and will advise you of the procedure. It may be better to also seek some legal advice if you are in Preston they have a community legal advice service tel : 0845 053 0013 - they might be able to help too

    Actually, you may find that if the defendant wants it heard at his court, then his request takes precedence.

    Do you have confirmation by the Police that they've investigated this lad and satisfied he's nothing to do with the theft? Have they given you any advice at all?

    Where about's in Nottingham did you buy the car, out of interest?

    yes the police belive him they told me,they cant proove anything, he's sayin he bought it like that and sold it like that, dident know it was stolen, although its weird how he managed to mot and service the car, in the 9 months he had it.

    what i dont understand when you looked at the car and under the bonnet and there was a large 2.0 litre sign on top of the engine cover ,why you didnt twig something was amiss, im not expert but surely that is basic stuff. ands why didnt you do a check on the vin plate at sign of the door to that on the v5 , or better still pay a fiver for a hpi check which can be done via a mobile text.
