Well, first guy paid more attention to fiddling with his big shiny earring than listening, and said 'there's nothing i can do'. Asked to speak to the manager who said 'call customer service' and promptly walked off. Customer service said 'once it's been sold and out of returns stage then it can only be sent for repairs'. Explained about missing work calls, which is true, and she continued as stuck record. Asked after head office. Said I'd get same response at it's nothing to do with us! Then she hung up!!! Nice!

So...let me get this right - I have been sold a faulty item (has cut out numerous times as i said in original post) but retailer takes no responsibility for it. They can go on selling faulty goods and there's no comeback? Interesting. Will send letter to head office, making sure to detail exactly how their staff 'communicate' with customers.

Glad you found a good'un to help you out tootiemac!

That just isnt right they have a duty to help you its covered by a years warrenty and I would say dont let them squirm out of it. I would seek advice form consumer advice and the obusman (sorry cant spell it) i got a number from the obus then used the online complaints line and mentioned the number never had someone call me back as quick in my puff.
Worth a try really hope you get it sort and keep us upto date. best of luck

As long as they are offering a repair, they are within the law I'm afraid. You have no right to a replacement, if you do get one, it's goodwill.

Yeah they are offering to repair the phone so they are holding up their end of the bargain

If it is so vital for work calls you should have looked at some networks business tariffs which offer replacements for faulty as a perk or taking out extra cover on the one you had.

It's what every single network does so it shouldn't have come as such a surprise if you research first, if it is as vital as you say I'd have said that was a reasonable step?
