Currys - Returning a disc

There is nothing to show the purchaser has not just copied the disc, before returning the original.
You can't expect the seller to go through activated / not activated checks when an opened item is returned. Have you ever seen ANY supplier selling previously opened software, without it being sold as a used item? I'm sure Curry's et al don't sell prior useage items.
Chance of a refund... Nil. Because of my first point.0 -
It depends whether the OP actually click "accept" to the EULA, In theory you have no way (in the shop) of reading the EULA until the software has been partially installed, People have managed it before, Mainly on oem installs but it is possible.
I guess it depends how truthfull you are about whether you clicked agree to the EULA or not, But thats up to the OP.0 -

This doesn't overcome the fact that there is nothing wrong with the goods they purchased, so what excuse can they have for getting a refund.0 -

I apologize, I have not installed windows 7 before as I use Linux on everything i can and my work machine with windows 7 came pre-installed.
I did not realize that you have to accept the License agreement before installing anything, Although i assumed that you would have to use the Serial number before/during installation aswell and the OP says that it has not been used.
I guess other than being dishonest and not admitting that you have installed it, Your only real option is to ebay it or beg microsoft for a refund based on it being "rubbish"0 -
I would say call MS and ask about your options - it is not like copying the disk is any use to anyone, and MS know that. They know full well you need the serial to use the product over 30d, and if the serial is unregistered, they may offer you some leeway. You may want to have the serial number of your XP install to hand to show you are not using a pirate copy. But remember, XP is now ancient, and support will be harder and harder to get on it.0
