Issues with Used Car from Garage! What are my rights?

URGENT advice needed please!!

Following on from my recent thread here.

I have now lost confidence in my recently purchased car, and more so the Garage whom I purchased it from. I am seeking advice here, hopefully more in depth than "ask for your money back" which is all I have gotten so far from the people around me. I am wondering what my expectations, and even legal right are.

Background

Audi A3, 6 years old, 60k miles. Purchased outright from a good garage(respected local Ford dealership). Car was not MOT'd/Taxed at time however I was told it was in good working order and they would get it up to standard for me, with a 3month Warranty. Paid upon seeing it and collected 10days later as they had saw fit to replace the clutch upon inspecting it which was fair enough, would rather have had it sooner however glad they were seeing to something that needed done.

Collected it on the 8th March, had it for only 2 days and then noticed the radiator fan would not go off, unless the battery was disconnected. They took it in, took a week to fix it, had to send it to an Audi garage as they could not work out the problem -they gave me a courtesy car(at near empty fuel), but what a hassle getting there and back so soon. So after a week I got it back, radiator replaced...

Within a day or two I noticed the engine was revving at idle and when holding fixed speeds. It was sporadic, and sometimes was very fine however you could definetly feel/see the engine/gage pulsing if driving. At first I thought it was me, others would not notice it however after just 9 days the probem had gotten worst and was easily noticed and so I took it to them last Monday. The young salesman even agreed over the phone that when he had driven it to the audi garage in regards to the previous issue, he felt something very subtly there with the revving. When I was up there despite being very nice and easy going(I really am a push over) they did not seem very apolgetic. Then when it came to the Courtesy car(I was told they had one for me) I was told they did not have one so they gave me an old Estate from their lot to take away, again with almost no fuel and very bad wipers(they only work on the fastest setting).

Where I am at now

I have lost confidence in the Garage and the car. I feel like after 3 months, which is closer to two now despite having courtesy cars for the majority of the time, the warranty will be up and the likelyhood of something going wrong on my own dime is very high. I feel like if I go to the garage and ask for an extended warranty of my money back(after buying insurance, car mats etc:() they will want to put up a fight... they have already spent so much on this car and they have closed the sale with my paying in advance, in mostly cash -foolish I know.

I am wondering what my expectations should be from the Garage now -perhaps these have been genuine faults which the Garage has not picked up. What would be my legal rights if I wish to take this further?...this is in Scotland, if that makes any difference?

I am certain they will call tomorrow to give me an update or tell me my Car is ready. I have no expressed my concerns before, however I need to tomorrow -I have been overly lax with this.

I would really appreciate any advice no matter how small.

Many thanks

While I sympathise with your situation, in fairness the garage has done their bit and tried to repair the faults.
As regards the courtesy car having very little fuel, that's common practice as customers do take the mickey and bring them back empty I've been told.

Why not wait untill tommorrow and see what the outcome is? You never know it may all be sorted!

If you get the car back and it's still not right then you have grounds to reject the car I reckon, so long as it's within a reasonable time and done in writing. Trading standards will have more knowledge on this - don't know what the procedure is in Scotland though so please check.

    Hope that helps!;)

I wasn't being funny, it's just much easier to keep up with the whole story if we have the previous posts as reference.... It saves us asking the same questions again etc

There was a recall on the radiator fans on the A3's of that age.

As for the ide problem, it's probably something simple like a MAF or a duff plug or coil pack?

    Thanks,

The garage has tried to do their bit, although I can not see how they failed to pick up at least one of these major issues. There attitude is very bad and I suspect that as I only have a 3 month warranty(and they have all the money), they are keen to get it 'out' as cheaply as possible so to speak.

I agree that the poor quality, and fuel less courtesy cars are minor concerns, and are maybe not relevent. However surely 2 major issues from taking receipt, and having to wait 10 days after purchase for it to be 'road worthy' is not a good sign. Like I said, I have had the car for 4 weeks on Tuesday, will have had Courtesy cars(2) for 2.5 weeks of that.

I have just lost all confidence and If i could go get my money back I would.

Give them a chance to fix the current fault - 2 faults in a 6 year-old car that didn't have an MOT at the time of purchase isn't that bad....
