    If you want to shop there again, certainly complain to Sainsburys CEO at Head Office - you don't have to say on which of those visits you were or weren't shopping in Sainsburys. The point is, I think Euro Car Parks' behaviour is much 'worse' than yours (yours only being a civil matter - there's is not!).

    Just be very careful not to name who was driving on any occasion nor mention whether or not the driver was shopping. Just say 'I have received this abysmal letter (grammatically and in its threatening content) as I am the keeper of this vehicle. The threats are illegal I believe and I would appreciate your response. The keeper was not necessarily the driver on any occasion...harassment is a criminal offence...no SIA licence...no clamping/towing signage means they cannot do this'...blah blah...

    Oh and how about saying 'I do not pay unsolicited and unenforceable invoices - if a car park contractor wishes to allege breach of contract or trespass I suggest they take the matter up with the driver at the time. A vehicle cannot be 'a persistent offender' and a registered keeper/owner is of course not liable in law for bogus 'fines' as I am sure your legal advisers will confirm.

    I find it reprehensible that Sainsburys believes that it has the power to 'fine' customers and even worse that you allow your agents to threaten people in your name. As all possible drivers of this vehicle are/were regular Sainsburys customers I am astonished that a reputable company can allow its agents to harass a vehicle's keeper in such an intimidating and illegal way...I intend to report the matter to the BPA and the press and ask for your comments on the threats issued by your agent'...etc.

    And I don't think they are talking about a Council tow. I think they hope that you don't know that they cannot clamp/tow vehicles and are trying to scare you. Complain!

    But - look for somewhere else to park when you are not shopping in Sainsburys. :)

    Correction.. they cannot legally clamp a vehicle or remove for past alleged debts, but since when have PPCs acted fully within the law? A lot of them stoop to some low tactics to get mugs to part with their cash, and although the law can step in, it has no teeth when it comes to forcing PPCs to refund cash or remove a clamp / release a car from a pound in a hurry when it is needed urgently. The wheels of justice turn very slowly.

    That doesn't mean that what they're doing is right, but given that they could carry out their threat of clamping or towing your car, I wouldn't p!ss them off to the point where they have the opportunity.
    also what happens if you sold the car, or someone else used it to go shopping ?
    PPCs don't care. They clamp first, ask questions later. They rely on desperate people paying up to release the clamp before questions are answered.

    Euro don't even do court and admitted so in the Sunday Times ;)

    Anyway if they did tow you without signs being there, it's a police and criminal matter , if it was me I would sit in the car, get a mate to bring an angle grinder and cut the lock off, still it's never going to happen in a sainsbury car park, can you imagine the uproar when the local press is called and everyone can see they trying to tow you illegally ? ;)

    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    So if they did tow my car, they would be stealing it basically, and I could have them arrested! Tempting.... but not worth it.

    Thanks for your replies and support, and also for clearing up the issues involved. This forum has opened my eyes to the deceptive methods many companies use...

    Agreed re the clamping/towing threat, but you need to stop taking the pi55 re parking there when you're not shopping. If the driver is a 'persistent offender', then they may be able to build against against that person. Identifying the driver is another matter altogether, of course.

    Wasn't there a PPC on here a week ago posting wrt a persistent offender [in Scotland iirc] getting done for £5k-ish [ie judgement awarded n court]. Not sure if it was a trolling exercise but they posted a copy.

    I guess if the company posts a contract on your windscreen and you then continue to park there you're far more likely to lose in court [the 'I didn't see the [too small] signs so no valid contract was formed' defence thereby failing]???

    Who's land are you parking on? Are they not entitled to say who can use it?
    Can I come and park on your drive if the road is full?
    You dare touch my car while it's on your drive, and I'll sue you!

    You're a liberty taker, and I bet it shows in other ways too.

    We live in a land where it's illegal to clamp and tow cars without signs and warnings! And don't give the garbage about parking on your drive, we are talking about supermarket car parks not about your views on people's drives!

    The council will not be interested in towing away a car parked on private land. Clamping (and towing away) are still legal on private land, as long as appropriate warning signs are in place.
