Where Do We Stand

My parents are in the process of having a so called 'mobility shower' installed. I had asked them not to sign up to anything without us looking at it first, but they did. It is a supposedly reputable, specialist company.

Anyway, the job is due to be finished tomorrow and my mum asked me to go round to look at the work so far. There are a few little gripes, a bit of a poor finish in places, they didn't move the existing toilet across as much as she expected etc but we could live with that. However, the biggest issue is the shower is about 150mm shallower than she was lead to believe it would be by the sales rep. The man installing it has told her it is the widest they do. It may well be but after looking around on the internet this 'mobility' cubicle isn't even the size of a B&Q non mobility shower. They told her she could have a wall mounted seat. They arrived with a stool, but did offer to show her a seat. When he showed her the seat it did not match the one in the brochure and he said it couldn't go on the end wall as that was a stud wall and could only go on the external wall, facing the opening doors of the shower and bascially if she did that her knees would be pressed up against the doors.

Therefore the product is not fit for purpose. She can't use it as a mobility shower. What rights do we have. They are expecting payment tomorrow (nearly 5K) but we want them to remove it and we will sort it ourselves. What are our rights?

I can't help feeling that an elderly person has been taken advantage of. The fact of the matter is the salesman showed her on the wall where it would come to, it doesn't and she would never have placed the order if he had showed her its true dimensions.

Any advice please?

    What sort of paperwork does she have detailing the design? i.e. does it give the size of the shower?

    If she can't sit down on the seat without her knees touching the door, then I would INSIST they install something that she can actually use before handing any money over, as the goods should indeed be fit for purpose.

    Can you be there when they ask for money, to give some moral support?

    dont forget when you start handing over money you lose any power you have to retain any money til you are happy.

  • Thanks for the replies. Yes we intend to be there this morning to make sure they aren't pressured. Sadly, they were very good at not writing down very much that they told her. He showed her on the wall where things would finish but no sizes were mentioned and the brochure is not much different.

    I spoke to the company on the phone last night and told them we want the cubicle removing as it will not do the job and it would never have been installed in the first place if they had told her its true size.

    I just wanted to check if we do have the right to insist on that.

    You don't have the right to insist on anything, don't forget it's your parents who are party to the contract not you.
