£2.95 Trial for TeethBrilliant cost my wife £129.95

Be VERY careful if you are considering signing up for a £2.95 trial order of TeethBrilliant teeth Whitening system.

Their website is very misleading as it looks like you are paying postage and packaging for a 30 day teeth whitening trial.

Buried in the Terms & Conditions you will see that you are purchasing a 3 day trial of the 'TeethBrilliant Teeth Whitening Portal' and that you have 3 days to opt out. After this time a charge of £127 is added to your card as full payment for access to this website. There is nothing on the order confirmation email that shows the additional charge or details the 3 day opt out window.

When I discovered this additional charge I called their support line in the US (free if you use Skype 001 877 213 1449) and explained that I did not want the portal access and was shock at the additional charge They very quickly pointed out that we had agreed to the terms and conditions and that we were outside of our 3 day opt out window, as such the £127 would not be refunded. What do you do? give up and accept the fact that you did not read the small print?

NO - Call back stating that you have contacted the Office of Fair trading and that under the "Consumer Protection (Distance Selling)" regulations you are entitled to a 7 day cooling of period.
Also let them know that the Consumer Response center at the Federal Trade Commission state that the salesperson must tell you about the cancellation rights at the time of sales and that they must provide details of the "right to canel" on the order/contract.

I did the above and they quickly agreed to refund my £127

Hiding additional charges in the Terms & Conditions is clearly a way to exploit extra cash from innocent victims, do not become one of them !

  • I too have been scammed by these people. I have not even received the free trial and have been charged £127.99 for this. I have sent them an e-mail and have also contacted my credit card company who are refunding the amount to me and are taking it up with PURE SYSTEMS themselves. I will let you know how it progresses.

    Which isnt hidden at all.. Now whilst i feel your pain at losing your money and maybe this is a different website but why are people so quick to hand over their bank details without wandering round the whole site first amazes me.. Its even powered by wordpress..

    hmmm.. Another thread with a raft of "New" posters slating a company and its "hidden" T&C's.

    Hopefully they are all genuine and hopefully they all get their money back. :A

    To be fair, I've just looked at this and it isn't exactly clear. I think what it is saying is that you are getting a 3 free day trial, but for signing up to it they will give an extra 30 day trial for free- BUT it's still actually only a 3 day trial so you have to cancel by then.

    All the big advertising says it is a 30 day trial so it's quite understandable to be confused by it- when I was reading the terms and conditions I initally thought they had made a typo and just missed a 0 off especially as that is the only time 3 days is mentioned.

    Not everybody is completely paranoid (although sometimes it pays to be), some people just take things at face value.

    Thats a good point and im not overly paranoid as im pretty savvy when surfing the web but some people just need to be more clued up about the sharks out there when entering your card details for anything..

    And it seems theres a whole load of people who want to whiten their teeth so badly and not through the dentist that i dont really understand it..

  • I really am surprised that you managed to get a refund after mentioning the OFT and the DSRs....

    Considering that they don't apply in this case!

    Daily at work i speak to people about this, so many people are angry, saying that they've been ripped off. Most of these "free trial"companies operate in the same way, their terms and conditions clearly state that you will receive further goods and that you will be billed monthly. I'm also astounded that people hand over their card details to a company they've never dealt with before without researching it first, Google is a fantastic tool, it takes seconds to type in the retailer name. The companies are not doing anything wrong, if people used a bit more common sense my job would be a lot easier !
    Assume everyone on the internet is a shark and you won't go far wrong ! Would you hand over your cash to a stranger ? No, so don't hand over your card details either !!!

  • Just wanted to let you know , I followed toade's advice yesterday and they agreed to refund me the money.
    They also said that they would contact my Credit Card company to inform them I was in breach of my contract. I informed them that I had already contacted them to tell them about this matter.
