claim against ebay

bought a new nokia n8 phone from a seller on ebay , phone turned out to be faulty so put in a dispute and was told by ebay to send item back for a refund.
ebay e-mailed us a label for parcelforce and sent the phone back like we were told from the post office within 5 days and got proof of posting.
kept getting e-mails from ebay saying that we would get refund when the seller received it but eventually found out that it had gone missing somewhere.
there was no tracking details for parcelforce and the seller said he had not received it back so even though we sent proof of posting to ebay they said that we had gone over the 5 days for sending it and closed the case so now i am over £200 pounds out of pocket and ebay dont want to know.
we even found a guy from parcelforce who said it was up to ebay to refund me and then they claim it back from them but have not heard anything from ebay .
so does anyone know how i can put in a claim against ebay.

    As you were returning an item, you needed to send it back with full tracking. Anything less and as you have found out, you get no redress from Ebay.

    As you cannot prove the seller has the item back with them, the dispute quite rightly has been closed in their favour.

    In normal circumstances you are paying for the delivery so you are forming the contract with Parcel Force and it is up to you to claim compensation if a parcel is lost but in this case where 'Ebay' (I assume you mean the seller) sent you a Parcel Force label it might be a bit more complicated depending on what this label actually was.

    If it was totally pre-paid and all you did was stick it on the phone then send it off then it may well be that the seller is responsible for claiming from PF and then refunding you. If however you paid any part of the postage fee then it would probably be down to you to claim the compensation (if it was you I hope you made sure you insured the delivery for the phones full value).

  • we did as we were told and used the postage paid label supplied by ebay and were told to take the parcel to the post office to send ,but somewhere its gone missing so no tracking.

    I'm confused ebay would not normally send you return postage labels. Are you sure it wasn't the seller. Also are you sure it was via Parcel force. PF services are all tracked so you would have got a tracking number. It sounds like it went normal mail. Considering the size of a phone it would not normally go via parcelforce.

    As others said if you cant prove you have returned it you have no comeback. Depending on what postal method was actually used you may be able to claim via royal mail with proof of postage. Although if it was normal mail the limit is £41 and if the phone was worth more you may get refused that as you will have been deemed to use the wrong postal method.

    I am surprised that people write replies hen they have no idea whatsoever about the problem... several posters questioned if it was ebay that sent the prepaid label - instead of reading properly what the OP said (said very correctly and without mistakes).
    YES! It can indeed happen. Ebay itself, in deciding the case, can supply the buyer with the fully prepaid label to send via parcelforce. the buyer has to print the attachment and go the the post office. It means that the buyer won't lose out on return post.

    The thread is approx 15 months old and back then it was not normal for ebay to issue return labels.

    It does pay to read the dates when advice was given as things do change.
