Please help me. I agreed to buy a bra from a friend of mine who is repping for Ann summers but didn't put don't a deposit or anything, she said pay whenever but since agreeing i've had some hefty bills come out of my account and I'm literally penniless. I've told her I can't afford it anymore and have changed my mind, thinking it should be no problem as I haven't put any money down or signed a contract, she says she can't return it and I have to buy it and Is now constantly hounding me for the money, even telling me to get my parents to pay for it.
Have I the right to change my mind and how do I make her see this?
Please help she won't leave it alone!

I'm not sure on this one... distance selling regs apply to catalouges, but not 100% sure about goods bought in a 'party' situation.
What if you had bought something that didn't fit? Would you have got a refund then?
Personally I'd blag it mention you'd checked and that the DSR apply so even if you did pay and then returned the item you'd be intitled to a refund. Good Luck! Some days you're the dog..... most days you're the tree!0 -
Do you have any paperwork for the order?0

No paperwork at all, just a text saying "sure why I'll take one". No deposit, I haven't signed anything either...0 -
Don't think she's got anythin on you then0

Why don't you complain to Ann Summers directly or speak to your local CAB, just to be sure of the legalities.
Don't let her bully you!!

Thanks everyone, I just wanted reassurance that I was within my rights to cancel! I've told her straight and used some of the jargon so I think she might get the message0

You may find that your friend has had to buy the bra from Ann Summers and sells it onto you adding her profit. It's not like she can now sell it to somebody else and she's out of pocket.

Do you have the bra? If not, then there is nothing your friend can do - tell your friend to send it back and she can have the refund or keep it for her party kit. If she is out of date with returning it, then she needs to chat to her headoffice ASAP.
If you do have the bra then pay up. You texted an agreement to buy one and have the item. This is a friend who will have already paid for the bra with Ann Summers, so she will have no bra and no payment.
Ensure your parents tell her to bog off though.0 -
You ordered it so you should buy it. Not fair that she is left with a bra ordered for you. You don't need written signed contracts to do whats right.0

offer, consideration, intention to be legally bound, capacity. Seems like a valid contract to me. Pay up.0
