    Well I also got the dreaded letter for a £100 win. Can't say I'm surprised as I knew I won on my 3rd entry of the day. As previously mentioned, I had only been entering for myself until I noted the post on their facebook wall responding to someone's query about winning twice in the same day (Velvet saying they would get both wins providing they sent 2 separate claims)

    Anyway, been speaking to a friend who is clued up in legal matters and she has advised that, although many of us did breach the terms and conditions of the promotion, it could be argued that the T&C's had already been breached by Velvet themselves and were therefore null and void. In particular, Velvet were in breach of points 5 and 6 in their T&C's and this can be evidenced by various entries on their facebook wall (evidence proving they paid out to people who did not send both the receipt and packaging shows breach of point 5; evidence that they advised they would pay out multiple claims from the same day shows breach of point 6)

    My friend also advised that, if this is reported to the ASA, the ASA will look to the CAP code (and in particular the part that covers promotions) to see if there is any breach of the code. If so, any complaint made may be upheld.

    The CAP code (12th edition) came into force in Sept last year and I haven't had time to read through it yet (planning on doing so tomorrow prior to contacting the ASA). However, the previous code (11th edition) did include a part that said promotions should be dealt with equitably (which I take to mean dealing fairly and equally with all concerned). Specifying how Velvet have paid out to some and the incriminating posts on their facebook wall is a good starting point to demonstrate that there has been nothing equitable about this promotion!

    Just caught up... hope everyone enjoyed the lovely weather this weekend. Got a bit of 'evening glow' going on myself now. My 5th (out of 6) velvet cheque arrived on Sat. I find it quite annoying that you don't know which win it is for though?!? :think: It could be one of two...my £10 when they wrongly paid me £1 or my £10 that I only sent off this week. Either way - it's a good result! And I had another £10 win yesterday... :) I'm definitely up on what I have paid for the t roll!

    Gonna exchange my clubcard vouchers tomorrow - double up on the beauty deptartment - then do a DTD shop :rotfl:

    Thanks for this, I think you are right, I am no solicitor but suspected they would not be offering to return packaging and postal charges if they were definitely in the right. I cant make up my mind whether to contact them re my wins totalling about £340 or put it down to bad luck. I dont really want the stress of it but having said that obviously could do with the money.

  • Just popped on to say that we thoroughly enjoyed our dtd lamb racks. :)

    I did mine in the slow cooker, just resting on some onion chopped in to large pieces and a couple of garlic cloves. Tasted absolutely fantastic and was melt in the mouth tender - yum! :D

    congrats Dawnie on getting your cheques, and thanks to needahol for the above info. I'll be very interested in any results from this, or indeed on how to proceed as the more people that complain surely the more chance we have of getting paid?

    I still have about 6 receipts and promo packs so anyone playing still, pm me at the end of the comp and I might be able to pass them on - but I am still playing once a day myself!!!! I was far too organised and as soon as I got the bog roll in the house I chopped off the barcode and red arrow before stashing the rolls.

    Not that I'm going to get any but I wondered the same too. So when I claimed for them I claimed in the names

    Interesting about breach of T&C - considering 2 people on here have been told that the FB page is not linked to Velvet, they are not responsible for it... how does that work?

    Who set up the FB page then? A member of staff without authority? or are they now denying it so as not to be liable?
