Just thought I would update on what has been happening since I posted asking for advice.
I had sent an email to the buyer asking him to send me a list of the discs which he claimed were not working.
I didnt get a reply from him for 2 days and so in the meantime something led me to check out his feedback...
It turns out that he has sold on 19 of the 21 discs I originally sold to him!
I emailed him saying that I wasnt willing to do a partial refund but that he was more than welcome to return all 21 discs for a full refund. I made it known that I had read his feedback and knew he had sold the items on.
Today he has emailed to say that yes , he did re-sell the discs and that 2 buyers had been in touch (a week after the sale) to say that the discs were scratched and that they want a refund.
I replied telling him that as the discs have been sold on to a third party it is almost impossible for me to determine WHO is responsible for the damage.
I told him that to comply with paypal policy I will more than gladly refund him the full purchase price PLUS postage costs on return of ALL of the discs.
I will wait to see what he says....
I think it is unfair of him to expect me to refund for the 5 discs in question seeing as for 1 I KNOW they worked when I sold them and 2 he left me possitive feedback to say that the discs were in full working order and 3 he has now resold the discs to a third party!
I also contacted paypal who say the my obligation to him as the buyer is to offer a full refund on return of the complete package WHICH I HAVE DONE.

In my opinion, it's time to stop emailing him. If he wants to open a claim, let him, he'll have to return the discs at his own cost, and prove that you received them too. Cut a long story short, stick to your guns and tell him that you're more than happy to fully refund him on receipt of all the items by tracked post at his expense and so long as they are in the same condition as when sent. You never agree to partial refunds, you're not obliged to agree and in this case, would certainly not agree because he has resold some.
Nothing he can do and nothing you can do. Returning them in this way is what he'd be required to do if he opened a case anyway.0 -

The thing is that he wont be able to return the discs to me - and possibly keep some for himself because he has actually sold all of them on to other ebay buyers (well all of them except 2/3)
You are right when you say that I should stop emailing him though . My last (and final) email to him stated that to comply with paypals return and refund policy I was more than happy to offer him a FULL refund on receipt of the goods being returned to me.
I KNOW he cant do this though as he has already sold them on.
To be honest I think he has a flippin cheek to even ask for a refund from me considering the discs could have been damaged by anyone as they have been out of my possesion for the last 3 weeks!
When I received the partial refund request from him over the weekend I was actually resigning myself to refund him as I considered he would open a paypal claim and WIN if I didnt.....im soooooooo glad I checked his feedback and discovered that he had re-sold the discs before I issued the partial refund

This is exactly correct. Because I checked his feedback and discovered that he has sold the discs on to other ebayers , he has informed me that HIS buyers are returning the discs to him for a full refund because they are badly scrapped and will not play.
Because of this he feels that as the original seller it is MY responsibility to refund HIM so that he can then refund the second buyer.

Ps . 3 of the discs have been resold to one seller. The other 15 discs have been sold to 15 individual buyers so the chances of him being able to return all 21 discs to me is slim...The loopy one has gone :j0 -

What a cheek, hopefully he'll have to refund his buyers & be out of pocket. I would completely ignore him I were you from now & block him from bidding on your auctions in the future.0

You are right...he does have a right cheek!
My guess is that he didnt expect me to find out that he had sold the games on to other ebayers....its at times like this im glad I am a tad nosey
. Having a look through his feedback certainly was to my advantage 
His last email to me stated that the discs were being returned to him by his buyers so looks like he WILL be out of pocket.
As Botanical says (correctly) though , this is not my problem (phew:rotfl:)
