return/refund advice

Hi , just hoping that I could ask for some advice with a situation.

Some of you may remember reading a post from me a few weeks ago where I had sold some cd's on Ebay.

The day they were delivered to the buyer he emailed to say that some of the covers of the cd's had got broken in the post.

I offered him a refund etc but he didnt accept as in the end he said that he was happy to go to one of the pound shops and purchase some replacement disc boxes.

I heard nothing more back from him regarding the matter....

Until today that is!

he received the discs on approx 7th March - so almost 3 weeks - and today he has emailed to say that a large quantity of the discs wont play and so he would now like to return them to me for a refund.

Now...surely he should have tried them before now?

Im guessing that im going to be made give a refund?

I know for a fact that the discs worked because I personally checked every single one before I sent them.

Will I have to pay the postage for him to return them to me?

Also , one more question...if a partial refund is requested by him then how the heck would I work out how much to refund?

I sold him 20 cd's , he says that 5 are un-usable so refunding a quarter of the price he paid sounds like the sensible option BUT some of the cd's were newer releases and so worth more than the ones which are from a few years ago.

    If he opens a dispute he'll be told to return for a full refund including original p&p, it will be up to him to get them back to you.
    Personally I would ask for them all back & on return you'll give a full refund. Paypal won't do a partial refund, it will be a full refund on safe return.
    If you'd rather do a partial, ask which ones won't play & look on ebay for completed listings & offer that amount back.

    Just to double check something you say....

    You have said that paypal wont issue partial refunds. Is this just with ebay purchases?

    The reason I ask this is that my Dad bought an item (a laptop battery) from someone and paid with paypal but not through ebay , and then it turned out the item wasnt as described . I went into paypal and opened a dispute/claim and one of the questions I filled in was to answer "how much of a refund are you claiming" ?

    Maybe ebay sales are different though , I just dont know.

    Im thinking that maybe asking him to return all of the discs for a refund would be the best thing to do ......

    A buyer can claim a partial refund but the seller does not have to agree and can hold out for a full refund on return of the full set of goods.

    Sorry I put that badly, Paypal won't enforce a partial refund, either of you can suggest a partial but the other has to agree.
    Or it will be full refund on return of goods.

    As hermum says, although you can opt for a partial refund, unless you agree Paypal cannot enforce it. With them it is all or nothing.

    Thanks for that everyone , I understand now.

    I am seriously thinking that my best course of action here would be to get the buyer to return the whole package to me.

    To be honest , he got a total bargain and if I were to refund the quarter of the final cost that I think he is heading towards asking then I have really lost out!

    He got over £400 worth of goods and the final selling price was only £59.....I only asked for £7 postage and it cost me £10 to post them!

    So,,if I refund him the £15 I think he will ask for then it really wanst worth my while selling them.

    Just as a side note , this buyer had left me feedback 2 weeks ago saying that all the discs were working fine and saying that he was more than happy with his purchase!

    Have you queried his feedback with him? i would send a friendly message along the lines of, I've just noticed that you left me + FB saying that all discs were working, have you possibly got two transactions confused? You bought from me, then list the cd's.
    If he's trying it on hopefully he'll agree that he's stupid.
    You could have sent them via courier for a lot less, check out the courier thread next time you want to sell.

    Hi Hermum.

    At the time of the transaction the buyer contacted me to say that the item had been damaged on delivery.

    It then turned out that it was only the cd cases which were damages and so myself and the seller came to the agreement that he would pick up some universal cases from poundland or the likes , email me when he had bought them and I would send him the price of them via paypal....However I heard nothing more from him.

    As we were emailing back and forth about the cases he told me in the email "All of the discs are working fine , its only the cases which are broken and this in no way hinders the discs . I am more than happy with my purchase and do not want a refund , I am happy to replace the cases cheapily , I did however want to make you aware that your packaging was insufficient".

    I emailed him back thanking him for his understanding and once again assured him that if he wasnt 100% satisfied he could return the broken cases and the discs inside them for a partial refund . Once again his reply was that he was happy with the item and did not require a refund.

    He then left positive feedback saying "An excellent transaction . More than happy"

    Then last night I received his request for a partial refund!

    Im thinking he has either copied the discs and so wants his money back on them OR he has simply changed his mind about them.

    either way , I sent him an email last night asking for a list of the discs which were broken/not playing and as yet I have had no response.

    I have decided that I am going to tell him its a full refund or nothing. He got a toal bargain and so if I refund him a quarter of what he paid he will have got over £400 of goods for £45 :eek:

    I will tell him to send them back (which will cost him a fair bit) and I will give a full refund .
