ebay or paypal?

Long story short i got sent some damaged items and wondering which is better to go via-ebay dispute or paypal.

    Don't automatically go for a dispute until you've contacted your seller first to tell them the item's damaged. This is what eBay ask you to do first. Give your seller a chance to sort it out.

    Tell your seller if you think the packaging was adequate or not.They may ask for photos, which is good if you don't want to send a damaged item back through the post. If they then offer you a refund and original p&p then fine, go ahead and return it tracked.

    If you've not worked it out with the buyer you have 45 days from the sale date to open a 'not as described' case in eBay.

    You will be required to return the item tracked at your own expense.
    (Contact eBay if the item's too smashed up to send safely).

    When the seller receives it you will be refunded the original cost of the item and the original p&p within 3 days.

    The seller's not obliged to refund your return postage costs, but a good seller will, especially if the packaging was inadequate.

    As botanical advices, except, if you do need to open a case, then Paypal and NOT ebay is the easiest and quicker method.

    I'd go for a paypal claim over an ebay one any day.

    Why do people prefer PayPal?

    An eBay case is the easiest, isn't it?

    Paypal is easier as it is clear cut, you know exactly what time frames you all have and you can respond to the other person in the dispute. Ebay is less defined, they seem to have a never ending time frame so a 10 day claim on paypal can apparently strech to well over a month if you do an ebay one instead.

    I also don't like the few threads we've had recently here and on the community boards where people have declined a partail refund offer from a seller and the whole dispute has been closed in the sellers favour. I think I owuld avoid an ebay claim until I was sure the glitches had been ironed out.

    I second raising directly with Paypal too. You are raising it directly with the payment merchant and i believe that they also place a hold on the funds on the sellers Paypal account, until the problem is resolved.

    Thanks for that soolin- Perhaps I've just been lucky, but I don't recognize those problems personally from any eBay cases I've been involved with.
    You can respond to the other person in an eBay dispute and there's a clear time frame to escalate to Customer Support who act in three days if the parties have come to a stalemate.

    However, what you said about partial refunds not counting in a case that is a concern whether it's PayPal or eBay disputes. Partial refunds are not a good idea on eBay because they don't stop cases being opened subsequently, or prevent the seller's partial refund being ignored and being asked to fully refund, despite the partial showing up in the PayPal transaction. Both PayPal and eBay Resolution Centres need to sort this out. Have you seen the recent thread on the 'Selling' on eBay all about this or was it here on Martin's?

    I'll just keep my fingers crossed that on eBay, trouble keeps on passing me by and hope I haven't tempted fate now)

    Botanical, lets just hope that none of us need to make a claim , so fingers crossed it is all imaterial. I can't recall the last claim I actually had to make, which is a good thing.

    I have had to make a handful of claims for damaged items as I collect vintage glass/crystal and it is surprising how many people don't know how to package things properly.

    Paypal is definitely quicker than ebay, because you can elevate a dispute to a claim within 1 day, whereas on ebay you have to wait up to 10 days if the seller does not respond.

    Personally I always contact the seller first if I receive damaged items, I ask for an email address to send pics to, and I ask explicitly if they will refund the return p & p as the damage was not my fault. Most often the seller has then offered a full refund on receipt of pics (as broken glass is worthless if broken and dangerous to post back to them).

    Occasionally sellers have either lied and said 'ebay will not allow' refunds of return p & p or have said it is their policy not to do this. In those cases I have gone straight to a paypal dispute and escalated asap as I have lost confidence in them (and decided they deserve a black mark on their seller dashboard).

    I sell fragile glass items and on the very rare ocassions something arrives broken I would not expect the item to be returned and would just refund. I can't imagine why some sellers would want broken glass returned anyway!

    Mind you my OH is a champion packer and I got a depression glass cake stand all the way to Australia last year intact. The only thing I;ve had break recently was a basic china mug, and that was double boxed, and I refunded without even seeing a picture of the damage.
