Somebody bought a contract on my name.

Following letter which I wrote to Orange.

I’m writing a complaint on my orange number XXXXXXX, I had requested orange to cancel my Sim only contract on 28th of February 2011 as my friend was using this SIM card and he was going to India permanently on this date.

I request you to listen to my cancellation call which I had made to orange in mid or end of January where I had clearly mentioned I will not be using this SIM card and if you get any call by mistake for upgrade or to continue this contract do not allow and I had given my alternative number to ring me as I already have a contract of T-Mobile for the past 30 months ( XXXXXX) and do not need any extra contract.

I called Orange on 23/03/2011 at around 18:30 to confirm if all my bills are cleared and I do not owe them any money but person who answered my phone did not even do data protection check and gave me the amount of £625.00 and spoke to me for about half an hour, I asked him sir can you please re-check the amount or is it £6.25 as I had SIM only contract requested again to check properly he said Feb bill is £65 odd and termination cost £560.00 I said to him I just have SIM only contract how can you put termination cost into my account.
He advised me that I will keep you on hold while I speak to billing department, When he came back said we had upgraded your contract and sent IPhone 4 to you and due to termination of contract there is £560 charge, I said how can you send me IPhone 4 when I cancelled the contract he later on said its you called us and requested IPhone 4 on 15th February 2011, I said to him that I haven’t made any call for IPhone 4 so how can you send the phone to anyone, I also said to him that I had set up the password on my account. Did you verify that? I also asked him now your talking to me you didn’t even do any data protection check with me yet this is completely breach of FSA data protection guideline. I also requested to block the phone as if this phone is in my name should not be misused but he didn’t have access to that system.
Our conversation was heated but I got clamed and asked representative for a help, he said if you haven’t ordered the phone then there has been a fraud into your account, I asked for a help he advised me to fax a letter to fraud department on 0870 376 5070 and they will investigate the fraud.
I have a serious concern that how did you send phone to anyone without doing a data protection it was breach of data protection where i had set up the password in my account & also had requested to cancel the contract on the top of that also had requested do not upgrade or renew the contract & how did the post man deliver the phone to anyone without checking ID proof? And I’m not living in London from 30th January 2011 as I’m working with Lloyds Banking group (Halifax Home Insurance) in Nottingham for 3 months contract.

I request you to call me on XXXXX to discuss this matter and advise me further step what do I have to do? as I work with the banks & Insurance companies in contract projects and do not want to spoil my credit history as this can also affect my career.

As diamonds says, that sounds like fraud on the surface.

Letters take a age to be processed. Call CS, ask them to lodge it with the fraud dept (they area a none customer facing dept, so CS can't put you through).
They will run an investigation and get back to you or notepad your acc for CS to call you. This can take a week or more. CS can't help you with this, they don't have the authority or the system to look into it.

Agree with Jon but also copy your letter to Orange Legal Team with the police CRN at Orange/Everything Everywhere's UK Registered Office
