  • It is if the non resident parent is paying on two seperate cases that they are then phased into the new system, not the other way round, a parent with care can have numerous cases and they can be assessed and remain on seperate systems

    Are you sure? I was always under the impression that if the PWC had multiple claims, then they would all be treated under the same system, but then I am an old rules trained person!

    It is to do with the person paying, not the person receiving

    I'm still not convinced. I shall ask my own case officer on Monday - I didn't get any reply from my usual contact!
  • Yes please do, as we can also see from the OP's post this is not the case and i have been to a tribunal and they are nothing to do with the csa and they know both the csa and the law inside out, and still it has not been changed but feel free to check anyway;)

    I have found 2 links which state that it is both if the NRP has more than one case and if the PWC has an old case then makes a claim the old case migrates to the new system.

    Could you please copy which bis you are referring to, but i cannot see it on either of your links, all i can see is if the NRP becomes involved in a new case in this case the OP hasnt been involved in a new case, the PWC has But not the NRP, maybe its late and my eyes arent working, or maybe we both reading it differently:o

    The new scheme starts for new cases on 3rd March 2003. Existing cases will normally not be migrated until (probably) next year. However, some existing cases that get linked to new cases will be migrated across early, so that where an NRP has 2 cases, they will either both be old-style or both be new-style.

    This leaves lots of questions over the details of how & when existing cases will get migrated early. Sooner or later, answers will be needed! Here are some of the questions. I've used some dates & amounts for illustration, but I would really like to know the general rules.

    The idea is that an NRP will pay under a consistent set of rules. Will PWCs receive under a consistent set of rules, or can they receive under an old-style case and a new-style case?

    The CSA web site says "It will not be possible to transfer to the new scheme from an earlier date. But if existing clients of the CSA are involved in a new case to which new rules apply, they will transfer early". This implies that linkage does apply to PWCs as well.

    Hope i have highlited that right, the client of the CSA is the person that has informed the CSA to claim on ther behalf

    I don't understand what you are saying. It says that either if a claim is made against the NRP OR if a PWC make a claim against another NRP - which it would have been in this case. The NRP's PWC made a new claim against another NRP thus bringing both cases under the same system.
