Just left the CSA Tribunal - all very sympathetic but that's about it...
My maintenance assessment was incorrect - but in their favour and as a result the CSA are going to be putting up my contributions by £5 a month. They forgot to include the child tax credit allowance for my girlfriends daughther in with our protected income calculations...
So effectively my girlfriends daughter is going to be chipping in £5 a month to the CSA for my son - that about says it all..!!
Can anyone tell me if my ex-partner can stop her dealings with the CSA and I pay her directly..?? I'm on the old assessment system and she's on benefits at the moment. What implications would that have to her..?

sorry you didnt get the result you wanted, cant believe they upped it.
as your ex is on benefits she cant call the CSA off you or she will lose her IS or part of it, she could effectively come off IS completely and have the whole of the maintance come to her, but then she will lose part of the other benefits she gets associated with IS, like HB and CTC. I doubt she will do that so I dont know what to suggest, it does sound like its going to be a struggle for you and I do think its unfair that you are on the old system and your ex's ex partner is paying under the new system

Admittedly - I've not had written confirmation that they will ask for the extra amount (as the Tribunal was only this morning)...
What's happened is that when the CSA recalculated my maintenance assessment after I moved in with my girlfriend whoever did the PI calculation for the household forgot to include the CTC element...
As a result as a household we have slightly more disposable income and I'm now able to pay the full weekly amount of £65.43 instead of having it capped at £64.11 due to PI...

I'm also sure his mother is doing a fine job bringing him up...
It just seems wrong that the maintenance assessment can count CTC as disposable household income...

I am still at a loss why you all think it has got anything to do with the OP what the father of the other child pays, or what system he is on? You are assessed on the system you applied on unless the OP was paying seperate monies to two different mothers then he would be automatically phased in if one was on one system and the other on another, but whatever someone else pays for their child is nothing to do with this, and in all honesty if between you you are paying what you say you are then mother in question is unlikely to be claiming income support

I asked - not to find out what he paid in maintenance but just to see that we were being dealt with equally and fairly (although this is the CSA we're talking about)...did you ask the Tribunal to confirm if your ex's other ex is on the new system? If so, what was the outcome?
The CSA representative gave the usual answer - they could neither confirm or deny that we were paying under the same/different assessment systems.
So for now - I know that I'm paying 28% (+ 5% for arrears) of my wages for a single child and that some pay more and some pay less/nothing...
I've decided to leave it all alone for now and enjoy what I have...
I just hope that the next incarnation of the CSA does a better job for all concerned...

Not to upset you anymore on a day thats been bad enough but how would you feel if your neighbour went to mortagage company to see what rate fo mortgege you were paying? you wouldnt be happy and thats why they couldnt tell you anything about your ex's other ex.
I really feel for you, although I have never spoken to you I have been reading your posts with interest as I agree with everything you have said. I think a lot of people were getting confused about what you meant on the other thread. If my understanding of it is correct you are angry because A) your paying more than the other bloke,
your ex isnt getting what you are paying as she is claiming benefits which will be nowhere near the amount you are paying no matter what some folk might think.
I really feel for you and hope that through time you get it sorted out and maybe your son will get the benefit of everything you are giving him.

Of course it is relevant - in law! If the law states that if a new partner claims maintenance through the CSA, then any existing cases with the same PWC have to be transferred to the new system, then the person concerned has a right to know if his case is being treated in the correct way. Of course they cannot confirm that the other case is being treated under the new rules, but there are ways to confirm this. All they have to do, is confirm that your case has been looked at in connection with the circumstances of the PWC and is being treated in the correct way. That's it. There is no need to know the details, nor does he wish to know them, but he does have a right to ensure that HIS case is being treated in the way it is supposed to.0
