  • I asked my gp for a letter to support my appeal for esa and dla and he flat out refused and asked me to " get them to write to me instead ".

    I have severe fibromyalgia and chronic fatigue syndrome, can barely leave the house at the best of times...

    time for a change of gp me thinks.

    My dear old mum (the crypt keeper) used to work for DWP and i have been told that there standered responce is to try their damndest to to find flaw in any claim no matter its nature to prevent ANY benfit being paid. yes i except that there are exceptions to ever rule.

  • Where do I get the strength?

    I spent most of my working career representing clients against HMRC - so I'm quite used to long drawn out processes, aggressive bullying and intimidation tactics and downright dumb comments from government departments!

    I also watched as my mum tried to claim DLA. She had cancer, severe and widespread arthritis complicated by deformities from childhood rickets and severe heart disease. (At the time she was waiting a triple bypass and aortic valve replacement and had just barely recovered from double pneumonia). The assessing doctor insisted she went up and downstairs despite the fact that she told them she couldn't and was under strict instructions froim her CV consultant not to. She had another cardiac arrest a few hours after the assessing doctor left..... Her application was turned down.

    So anger drives me.

    what annoys me is the lies these so called healthcare professionals come out with in their reports... we're warned that any fraudulent info in the forms can get us into trouble, so how is it fair that they can get away with it too?

    i know someone who is on IB, has been for more than 20 years with a bad back, he works 5 days a week on the side, just renovated his house inside out and yet he claims, DLA top rate both elements and gets IB.

    I can barely get up the stairs here, had to leave my job because i could no longer cope yet im not entitled to a penny.....

    a friend of mine sufferes from all sorts stemming from an inner ear problem, she cant walk straight, she shakes all the time and cant hold anything with out dropping it, she is very incontinent, the drugs she is on have given her liver disease, she is partialy deaf in one ear and needs someone with her to help her all the time. She applied for DLA and was refused, she had a doctor come round her house to assess her and for some unknown reason he said he couldnt see anything wrong with her!

    I told her to appeal against the decision as it was ludicrous, they sent another doctor round, who was very sympathetic, he said part of the medical was to see how far she could walk but on trying to stand up she fell and he said thats all he needed to see and didnt want to put her through any more so the rest of the medical was left and he wrote his report stating why he couldnt carry on with it. DLA STILL turned her down, so she appealed again was told she would have to attend a tribunal, it took around 3 months for the tribunal to hear the case, and my friend was in a wheelchair by then as walking was impossible, the board were very nice, really sympathetic and said there and then that she had won the appeal and would be awarded the higher rate mobilitly and care for life, but they would not back date it, which my friend didnt care about as long as she got what was due and was believed and not being made out that she was putting it on.

    So my advice is anyone who gets turned down should appeal straight away as the tribunal board are not just DWP members but members of the general public as well so its all fair, yes its an anxious wait for some but if you have a disibility and are entitled to help then make sure you do what you can to get it.

    The good days/bad days debate, well I wrote about good/bad/average days and then said how often each occur. No need to dress it up just be honest, and use extra paper if necessary that's what I did.

    The best advice really on the good / bad day scenario.

    I don't know about other applications but in my case the hold up was due to my consultants taking a long time to fill out the forms rather than any fault on behalf of the Decision Makers/DLA process. I received letters to apologise and tell me that they were processing my application but waiting to hear back from doctors.

    I think it's just that you tend to hear when people don't get awarded DLA as they turn to forums like this for advice.

    My DLA was renewed within five weeks and I have never had to appeal a decision, was awarded first time. It does happen, it's just not heard of all the time :)
