I'm having one of those days..I've come across a daft seller that is making my head ache and I've potentially got an issue with a buyer, plus I must have been in a dream one day last week when i listed as my postal prices for a new line have all been wrong and postage was actually dearer than I had charged.
I've packed all my wrongly charged items and will have to write of those losses and i've changed all the listings I still have without bids.
The problem buyer is a US one whose item hasn't arrived after 3 weeks so I refunded with apologies. Yet he isn't happy, he can't believe his item hasn't arrived and is demanding to know what I've done with it. We've exchanged a couple of emails and i've explained that as it is a heavy item it might be caught up with the issue that other sellers are having of delay through import. So he now wants me to find out which customs or border agency has it and phone them and tell them to send it on...arghh. I feel a neg coming on.
As for the seller. I saw a small item (less than £4 with postage) and put in a speculative bid as the seller had some poor stars and some very odd trading terms and I rightly thought it would put people off. So I got the tiem at opening price and paid Thursday. The listing states that buyers need to add a further £1 for recorded if they want buyer protection, it goes on to say that if a buyer doesn't pay the additional £1 then he is legally allowed to take that as acceptance that we will not persue him for a loss, and he even says he checked with paypal and they have said he is legally allowed to do that.
Anyway, Saturday morning I got an email telling me i needed to pay an additional £1 as per the listing and i had 48 hours in which to pay before he made a formal complaint to ebay about me. I emailed back politely and just said I prefer not to use recorded so will not be paying any more than the actual invoice payment and would expect my item posted Monday (today) as he states he posts every day.
I've just got a really tetchy email back saying that he will now be waiting until he withdraws my payment to his bank account before he posts as he considers me a hostile buyer and if I make any attempt to leave him feedback he will take legal action against me. He also assured me that my account is at risk as ebay have bene notified that I am refusing to pay the additional insurance as per his legally enforceable terms.
Goodness, I really do have a headache coming on.

Wow you seem to be getting the worst of Ebay at both ends!
I wouldn't enter into any more conversation with the seller; if he posts it late just neutral him and leave him a low DSR for despatch time. It could be worth passing the e-mail with the threat of legal action up to EBay though
As for the buyer, I've had similar before, I just saidI would investigate with customs, but if it hasn't arrived after xx days then I will refund (please let me know if it turns up after that so I can cancel the claim against RM). Also please be aware RM will be in touch to confirm you didn't get it etc etc (presuming it is RM). They didn't get the item but seemed satisfied with my answer and I refunded them later and didn't get a negative.

You have to wait 25 days before you can claim from Royal Mail for missing international post, so you could ask them to wait until Friday, at which point you will refund in full.
Oh, and just explain that you don't track on these items as it would increase their postage costs by xxxx.0 -
You seem to be infectious soolin - I have sold a length of fabric that I measured wrongly. How? I immediately offered either a full or generous part refund, and the buyer is being gracious (and getting a real bargain). Now I feel so jumpy that I'll check all my current listings, always a great way to spend time.0

My item was from around that time as well and I have already refunded, frankly I don't know what else I can do for my buyer. He doesn't appear to understand the huge volume of items carried daily from the UK to the US as otherwise he wouldn't be expecting me to phone someone and describe the package to them to see where it is.You seem to be infectious soolin - I have sold a length of fabric that I measured wrongly. I've never heard such tosh from a seller. Standard delivery doesn't mean you give up your buyers rights.
'pursue him for a loss' is an elastic term!
And do they not care about their feedback? It seems strange that they're making such a fuss over £1.
Not paying for recorded delivery does not negate your buyers' protection and RD is 75p.
I find it quite disturbing that this seller is presenting their terms on eBay in this way.0 -

I think that's why I got such a bargain, most buyers were steering well clear, he has dozens and dozens of unsold items. It's only an item I can use for my business, I would expect to pay at least £2 -£3 more from any other seller but as i knew I was protected I decided to chance it.
Strangely enough the overall feedback is fairly oK, 3 neutrals in the past few months so he is showing 100%, his stars are all fairly poor.
