samsung LCD SOGA?

After some advice on SOGA on a samsung LCD model LE32B450C4W
I purchased it from comet in late november 2009 it has now developed an annoying buzzing/vibration type noise on the speakers,does not happen all the time seems to be at certain tones mainly on deep voices.Volume does not have any effect on the noise,tried different inputs and still the same so defo the set and not a lead issue.
Not got in touch with samsung yet just thought i would get some advice about the SOGA and if it should be covered even though outside 12 month warranty period?
tried adjusting settings with no joy is there anything else i can try first?

There's usually a 3 yr warranty on Samsung monitors afaik.0 -

It's barely out of warranty - what shop did you buy it from?
If you got it from one of the big chains then your next stop is definitely to write to Samsung, I always find snail mail is best but you might want to start off email as theu are a tech company and see if you get a reply from customer services.
Say something like how delighted you were with the TV at first, really big up their company etc, and how disappointed you are to have a problem with it at this early stage as it is not a cheap telly. Once you have complimented them, then explained the problem, ask if there is anything they can do about it. If you get no joy on the email, snail mail a complaint to customer services at their HQ, if you get no joy from them then the next stop is the highest person you can find in their HQ.
You should get a positive reply - it is not as if you bought a cheap and nasty TV, you have every right to expect it to last a reasonable length of time, for a TV that is of reasonable quality then I would certainly expect it to last more than 17 months.What is this life if, full of care, we have no time to stand and stare0 -

I was sorry to learn of the problems you are experiencing with your Samsung LE32B450C4W. At this stage, due to the age of your television and as there is no evidence at this stage that the fault is due to any defect, any inspection would be conducted on a chargeable basis which would comply with the Sale of Goods Act.

Don't be fobbed off by Comet. Your TV is clearly not of satisfactory quality due to its unreasonable durability under SOGA. Get an independent engineering report of the problem and then seek legal recourse through the retailer. If in doubt seek further advice from Consumer Direct, Citizens' Advice Bureau, Trading Standards, Which or many other consumer organisations.

The following is reproduced verbatim from the actual Sale of Goods Act:Where the seller sells goods in the course of a business, there is an implied term that the goods supplied under the contract are of satisfactory quality.
(2A)
For the purposes of this Act, goods are of satisfactory quality if they meet the standard that a reasonable person would regard as satisfactory, taking account of any description of the goods, the price (if relevant) and all the other relevant circumstances.
(2B)
For the purposes of this Act, the quality of goods includes their state and condition and the following (among others) are in appropriate cases aspects of the quality of goods—
(a)
fitness for all the purposes for which goods of the kind in question are commonly supplied,
(b)
appearance and finish,
(c)
freedom from minor defects,
(d)
safety, and
(e)
durability.
Effectively your TV has a fault after only 15 months of ownership that means its durability is inadequate in that it no longer meets the standard of satisfactory quality and fitness for purpose that a reasonable person would expect.
Any reasonable person (i.e. not with the vested interests of a retailer) would expect a TV to be fit for purpose for more than 15 months. In fact, depending on the type of goods, the SOGA allows you to claim up to 6 years from purchase.
The really annoying thing about this is the retailers take advantage of customers not knowing their statutory rights (even though their legal departments fully understand) and, just like the previous post, will make every effort to obfuscate what is rightly yours to claim by an Act of Parliament. Fortunately you will find that the Small Claims Court is far more reasonable than the retailer in deciding these matters.
You should not have to fight for your legal rights but sadly that's the way it is.604!0 -

It's disappointing that the Comet company rep should be so selective when quoting the facts.
It's true that any inspection would be chargeable, but he fails to mention that if the supplier insists on an inspection and that inspection finds no evidence that you have abused the TV - which means it must have had an inherent fault - you can claim the cost of the inspection back from the retailer that supplied the TV to you.0
