Whilst you are right that your husband will be assessed using the criteria in force when the ESA50 was completed, the criteria listed above are the ones that would have been in effect at that time. The new one for Communicating only has one paragraph.These are the newly worded descriptors though that come into effect on 28th March 2011.
Surely as my OH was assessed prior to this, the old descriptors should apply shouldn't they?0
