    Just remembered, have been meaning to ask, how can I find out how many points OH scored at the last interview because it doesn't show this on the ESA85 form.

    I used to do ESA interviews at the JCP.

    They won't be able to offer any advice or help I'm afraid - their role is to help your OH think about work, and to point him in the direction of any training etc that he might need.

    Appeal as soon as you can, don't wait to see the Advisor.

    Thank you for the advice, but I just can't face going back to the assessment phase and waiting months and months for a tribunal, which may result in nothing.

    This is why I was asking the question, can you QUERY which group you have been put in over the telephone with the DWP? (as opposed to starting an appeal process)

    So if you go for ESA exam and are told to go on JSA and you then appeal there is only 10% chance of a change? I will have to let my friend know about that as her husband is trying to appeal.
    i think reconsiderations have a 10% success rate but i'm sure appeals have a 40% sucess rate (at leat thats the number i've seen said on here)

    As above - There is only a 10% chance of a success for the claimant when they do a reconsideration at the DWP. If the reconsideration is unsuccessful they can then appeal to an independent tribunal where there is a better chance of success - though still less than half.

    Its a pity that people don't photocopy the ESA50 and send it both to DWP AND ATOS then they would both know the problems.


    I did photocopy it! What if once I have received the ESA85 and have made comments re any inaccuracies on that, if I send it together with a letter just asking them to reconsider?

    I'm pretty sure the DWP do get the ESA50 after ATOS have had it.

    It's enclosed in the ESA55 (Folder that the documents used to make a WCA decision are kept in).

    Oh right, so you think they do actually read it then after all of the effort and hard work that goes into putting it together.

    My experience is that they do read it. Its just not given the same weight as the report from the HCP unless backed up with hard evidence from a specialist etc.

    You want the ESA85 ESA Decision Maker's Scorsheet - basically the discriptors telling you how many points and which secion a breakdown of where all the points went.

    I phoned DWP this morning to request a copy of the ESA85 and at the same time asked about a reconsideration to move into the support group.

    He was a bit offish and basically said that whatever group they put you in is the correct one! Anyway I also brought up the point of being put back on the assessment rate ESA if we did appeal and he said no you will stay on the ESA WRAG rate during the appeal as this has already been awarded. I did ask him to confirm this again, which he did.

    When I asked about the number of points my OH scored, he said that is shown on the medical assessment form ESA85, but it isn't is it? I couldn't see it anywhere on the last one.

    So I am now thinking that I will request at least a reconsideration and send a letter explaining why, rather than filling in the appeal form.

    Nothing to lose I suppose.
