Item not as described ... What should I do?

Well well - He has replied and told me that he is not going to give me a refund.
I have submitted a claim with paypal item not as described and the cheeky monkey said "if the problem is with the pencil then I will discount £5 for some new ones"
I have now escalated the clain and said this :
I purchased this Item in good faith - It was described by the seller as "Nearly new" condition. I paid a premium over other similar items listed on ebay due to description being "Nearly new - Excellent". When I opened the package I was very dissapointed - It had clearly been very well used. The pink colour had faded and gone a yellowish tint, The pencil had been chewed, There were slight scratched on the cover and the screen, but worst of all it is absolutly filthy, There is what I can only describe as brown grime in the pencil slot (It looks like ear wax) and I have picture proof of this. I believe that the item is not as described and I believe the seller added the "nearly new" comment in order to get a premium for this product. I am happy to return this item for a full refund.
What do you guys think? What are my chances of getting the refund? Here is a picture of the brown grime

If you haven't escalated the claim now is the time to do it. Return the item via special delivery, not recorded. Add the tracking details to the claim. Once the tracking shows as either attempted/delivered or refused, you can add that info or ring paypal and ask them to review the case. You will get your refund, in full including the initial payment for postage, but you will lose the returns postage.0 -

Once you have escalated it should give details of where to send the return. The seller doesnt have to 'agree', it is Paypal that directs this.
As long as you send it tracked, the outcome will rule in your favour.0 -
Items must be sent by tracked post before a refund is issued. Refund must be issued within 3 days of the seller receiving it back. You are entitled to the original price you paid for the item plus any P&P costs you paid the seller in the original transaction. Any hope that the seller will refund you for your costs for sending the item is long lost now. Sellers are not obliged to, but a lot of good sellers will. Just checking paypal and it doesnt seem to want to let me return the item yet is says "Being reviewed be paypal" the next step is then Item return but this is greyed out at the moment and I have no return address for the seller.0

yuk, looks like nicotine stains to me tbh, when i sold my girls ds lites, they were 2 years old and still as pink as when they got them new
like the others say, when you do return it make sure its via special delivery,

Well the plot thickens - Paypal have now ruled in my favour and have told me to return the item for a full refund.
I know everyone has said use Special delivery BUT the address registered on Paypal is in Greece (Great this is going to cost me more to return). I know the item itself was posted from the UK. I think that the seller is a foreign student living in the uk.
I have contacted Paypal and they have said they will email the seller and ask if there is another address to return the item to but have said if I havent heard from them within 4 days to go ahead and post it to the greece address.
What postal service shall I use for Greece?0 -
Did the item come from Greece? If not, ring Paypal and ask for the UK address.

Thanks for the replys - The item was definately came from the UK even the sellers name has the name of the town in it. When Paypal ruled in my favour they gave me an address in Greece to return the item to. I have contacted paypal and they have said that this is the only address linked to the paypal account. Paypal did say that they would email the seller to see if he would like the item returned to a different address but he has not replied - I only have a few more days to get a tracking number so will have to send to the greece address. How should I send it? Would Royal Mail international signed for be enough?0

Sounds quite confusing to me, does it give a UK address in the listing? Was it definatley posted to you from the UK?
If its a greek student studying in the UK I can perhaps see why they hve their 'home' address on the account, but surely they would agree to you sending it back to them from where they posted it from?
Im not sure that RM tracking is garanteed outside the UK (im sure someone with more knowlede will advise you soon) I would check that first before sending, if you cant prove its delivered, (or attempted delivery) then you will not get refund, and he may still get his DS back!0
