Right cool cool. Does it work the same down here of me being forced into a job that I don't feel able to do. I have bad IBS and anxiety issues, and again was told I wouldn't be able to get ESA for them, but they limit the jobs I can do as I need regular toilet stops etc.0

im not sure if it's different if you dont actually receive any benefit.0

Hey Allen, I am classed as his partner. but IF I was to be named on his ESA to get a Joint ESA amount we would lose out on his IIB which I don't think is fair and we would get less money than we do just now. And that was the DWP that told us that.
I'm sorry just cannot see how you would lose money if you were put on the claim, his income is high enough, therefore the claim would be joint but you wouldn't gain and therefore you would have proof of benefits for unemployment purposes.Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.0 -

Just tell them at your interview as they can put restrictions on the claim on what you can do, it would be better if you took over caring responsibilities and you would then have your own income.Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.0 -

Ok I'll explain, he gets £390.60 per month for DLA, £174.96 every month for IIB and 112.66 ever two weeks for ESA as paying back a crisis loan. Now they have said, if I get added on as an ESA partner to get the joint amount then they wouldn't be able to pay him the IIB as it would take him over the threshold for amounts or something.
I don't understand it either, I seem to understand less and less everytime I end up on the phone with them and want to cry more and more.0 -
Receiving national insurance credits where no entitlement to JSA40aA client who is not entitled to receive either contribution-based or income-based JSA, for example, because of an insufficient contribution record and too much income or capital, but who meets the labour market conditions of being available for and actively seeking work, may still be entitled to national insurance credits and can therefore protect her/his national insurance contribution record.
and
Physical, sensory or mental conditions51A client may restrict her/his availability in any way (provided that the restrictions are reasonable) in the light of her/his 'physical, sensory or mental condition'. The client will not have to show that s/he still has a reasonable prospect of finding work, but the restriction must be directly related to her/his condition. This could include restricting availability to less than 40 hours per week.
Good luckForums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.0
