i ve been given a 30 day consultation period to change my working hours from monday to friday to sunday to thursday along with 12 other employees,we`re part time and full time workers, i had my first consultation last week, told them i couldnt do sundays due to family commitments, but would cut my hours to a 4 day week, monday to thursday. Had my second consultation today they will not accept a 4 day week, and asked me again to work the new hours to include sunday working, again i told them no, ive got my third consultation on the 28th March, the whole consultation period is due to end on 4th april, i`ve been with the company 12 years this year some of the other staff a lot longer, any advice please.

we`ve been given 3 reasons, 1st, to stop the need for over time to cover holiday leave,, 2nd, the cost of keeping the building open after 6pm on a friday, 3rd, friday causes unwarranted management to staff ratio costs,0

Does your contract have any flexibility clauses in it?
Have a read of this: http://www.direct.gov.uk/en/Employment/Employees/EmploymentContractsAndConditions/DG_100371160 -
yes there is, it says. `there is however a requirement for flexibility in your working patterns to meet the needs of the business and you will be given at least 7 days advance notice of any significant change to your working rota`.0

So 30 days is pretty generous.0

apparantly they`ve got to give so many days notice, but at the end of the 30 days my current contract will be ended by my employers and i have to sign the new one to include working sundays or im out, can they do this ?0
-
Yes they can. How long have you been there?
Did you read the link I posted? It explains all that in there. You don't HAVE to sign the new one, they can't make you work in a role you don't want to.
You might want to give ACAS a ring.0 -
thanks i had a read, i`ve been there 11 years 6 months, in april, i`ve also been told that some kind of rule applies if i have a child under 16 which i have, but i`ve hunted all over the internet and cant find any thing so maybe that isn`t the case, but i have decided i wont be signing the new contract.0

Hi
the rue that you need is the Flexible working policy.... if you have a child under 16 (or a disabled child 18 or under) you can request to work flexibly across the week. All of my views are my own0 -

But OP has already tried that by asking to work Mon - Thur and employer has turned it down (as is their right) as they require Sunday workingThis is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0
