Sorn Question

Hi,

I am currently taxed until June but my insurance runs out tomorrow (I will not be renewing). I have sold the car but it is not being picked up until Friday.

My question is I know I have to sorn the vehicle and keep it off road (no problem here - I will keep it up the drive) but do I have to send in my tax disc or can I keep it for the new buyer?

    Continuous insurance doesn't apply yet. Just park it on your drive and wait for the buyer to collect.

    You can cash the tax disk in after its collected if you want (or sell the remaining months to the new buyer).

    Presumably the buyer is going to show up on Friday with the money, and his own insurance and drive (with the tax disc in place) off into the sunset. I personally wouldn't bother with a sorn for the short period, but that's just my opinion.

    I remember reading something to the effect that the DVLA will send a letter warning that your vehicle isn't insured before coming banging on your door. That's not going to happen in a a couple of days is it. Another ill thought out piece of legislation.

    If you sold the car with tax, keep it on the car. If you didn't, you can cash it in, but then the new owner can't drive it away without getting new tax first, so make sure he knows what you have done.

    It came into effect in February I believe :eek:

    Please can you provide some authoritative source for your statement.

    DirectGov just says "from early 2011".

    Just been searching some posts on here because that info was definitely given on a thread regarding this, not found owt yet . found this on direct.gov tho'
    What will happen if your vehicle doesn't have insurance

    If a vehicle does not have insurance, the registered keeper of it could:
    • receive a fixed penalty of £100
    • have their vehicle wheel-clamped, impounded, or destroyed
    • face a court prosecution, with a possible maximum penalty of £1000
    An Insurance Advisory Letter (IAL) will be sent to inform the registered keeper of a vehicle that appears to have no insurance. It advises the keeper what actions to take to avoid receiving a Fixed Penalty Notice.

    Sooo, "early in 2011" has now become "late spring" but I remember following a link which stated "1st Feb 2011" .. can't believe everything you read on the net :o

    It is now the law and has been since 4th February. However, that doesn't mean they have got the wheels in motion yet and started enforcing it. That was a helpful/informative post you found on the subject :p I would hope for some sort of announcement or publication on direct gov to give a start date.

    I think the OP would be ok not to SORN yet assuming that giving the tax disc to buyer was part of the bargain.

    If OP SORNs then he has to return the tax disc, yes.

    My advice OP, as you are insured until tomorrow, Thursday and buyer is picking up on Friday and you are happy for buyer to take the tax disc. The car will change hands on Friday, new keeper will be from Friday, so it won't affect you because he will be the keeper effective from Friday (the first day of no insurance) - and I suspect he will be insured from Friday anyway so no problem.
