    I'd recommend selecting option 2, regardless of what Egg have done
    I drum and knit to help Independent Drummers and Knitters to comply with their rhythms and knitting patterns. Although I am qualified to, I don't advise drummers or knitters for reward.

    If the FOS have recommended Egg pay you distress and inconvenience, and Egg agreed to the recommendation, and you agreed to their agreement, then I think we can all agree that Egg will have to pay you.

    Almost.

    The rules are:

    Initially your complaint will go to an adjudicator. Adjudicators can only recommend. If they do and BOTH sides accept the recommendation then it becomes legally binding on both.

    When the adjudicator makes a recommendation, the side they have found against has a chance to respond. If they find against the complainant, it will only be referred to an Ombudsman if the complainant tells the adjudicator they disagree. If they simply do not respond, the matter will usually be allowed to drop.

    On the other hand, if the firm simply doesn't respond, the matter will have to go to an Ombudsman.

    Sometimes, another adjudicator may pick a case out of the queue and attempt to resolve it but otherwise it will go to an Ombudsman.

    The Ombudsman's decision is binding on both parties, as src007 says, provided the complainant gets an acceptance of the decision back to FOS within the specified time limit.

    It doesn't have to be a "head" ombudsman, though.

    I received a full break down of the costs in a covering letter with the cheque. That breakdown does not include any mention of £200 comp. The FOS agreement which I signed, and Egg accepted is quite clear that on top of the PPI refund, contractual interest refund, and 8% simple interest, there would be £200 comp.

    I have informed the adjudicator at FOS, and he has emailed Egg to find out why they haven't included it.

    I await a response from Egg, via FOS.

    Congratulations to your success on claiming the PPI back.

    Can I ask you if there is anywhere you had to sign for the PPI cover, as my husband had the cover and on the agreement I cant see where he has signed to ask for it.

    It totals about £1900.

    I signed up for my Egg Card online in 2001. The section about PPI was in smaller text and the box for "yes I want it" was pre-ticked. I didn't notice this.

    However, when the forms came through the post for me to sign, there was only one box to agree to everything, not a seperate box for the PPI.

    Ha Haaa! SUCCESS!!

    FOS contacted Egg about the absence of the compensation payment, and they agreed it was an "oversight" on their part.

    Seperate cheque in the post as we speak! :D

    Just goes to show perseverance pays off. I've seen a lot of Q's about claiming for things over 6 years old. My PPI started at beginning of 2001, and when the claim began at the end of 2009, that was 9 years old, so obviously institutions like Egg DO keep records that far back

    Now question is, do I go for Intelligent Finances' Jugular for PPI on a loan from 2003.........

    I am so pleased for you.

    I am in the same position as you, took out Egg CC in 2001 and my case is with an Adjudicator as we speak so fingers crossed. Do you mind me asking your reasons for misselling?

    no probs,

    two reasons. First, when I signed up online, there was a pre-ticked box for the PPI, meaning I played no active part in selecting it as an option, and as it was pre-ticked, no information was given to me to aid me in the decision as to whether it was something I should untick.
    Secondly, I was in employment which provided me with sick/redundancy pay, so I didn't really need it anyway!
