I mustve misunderstood some of what I read then. I thought fees could escalate.
I emailed a local solicitor firm last night to see if I'd get a reply from them. I did get a reply...
It said that I do have a case for a claim, however they guess that I won't see any cash from total fitness & that my best option is perhaps "one of their alternatives".
Bit of poor advice I thought. I have a case, yet I shouldn't take it on & it's unlikely they'll pay out?? We'll see what comes of my letter to TF. I suspect nothing, but I've been wrong before.0 -
Did you read the local rag tonight ? Local lawyer is urging gym members hit by the closure to launch a group legal action. Not sure of costs but there must be economy in numbers and as one of the aforesaid I might contact the Lawyer to see if it is worth pursuing.0

I to have been a victim of the sad closure of total fitness this despite having asked prior to joining on the 14th of febuary 2011 the assistant manager if there was any truth in a rumor going about of finacial problems T.F. were having -my answer was of not a chance --" Barclays bank had just taken over " with that reassurance given by the person representing T.F. club i paid my upfront years membership--( as advised to save quite a few pounds) -
I find myself now £385-00 out of pocket and have been in touch with my credit card company to try and retreive said money --surely after less than 30 days i should be entitled to a full refund from T.F --

There seems to have been a bit of post chopping here. I'm sure there were more responses than that after my last post when i checked on my phone this morning??
Victor - it's people like you who i feel sorry for - people who have not long signed up. Whether the staff knew or didn't know about the closure, we don't know (unless any of the MSE members know the staff who worked at Lancs TF??), but i'd bet that as the time got nearer that at least the club manager would know something?! I can't imagine that Tuesday, the landlord turned up & said right i want you all out by 5pm ... and they'd STILL be taking memberships, which is not on imo.
I read in the Guardian about a solicitor that's mentioning going as a group. I contacted one the other day who got back to me saying "you have a case, yes, but i guess you wouldn't see any cash. It might be better to try an alternative".
I replied saying i'm assuming that this alternative is caving in to their VVV push & that if i have a case, why should i try an alternative & why wouldn't i see a penny? It's been a couple days now & they've yet to answer that one.0 -
Any Lancastrians been chasing TF for their refund? Via email, letter, phone call?
My letter was posted 1st class recorded last Thurs & i'm still waiting on a response. Gave them 10 days.0 -

As i say, i posted off the letter to TF & predictably, they've yet to reply. Should i send a copy of the letter via email also, referring to the letter by snail mail, or should i just leave it & sit out the 10 days i gave them? What do you reckon?0 -

I am now wondering what to do after ten days are up??
Credit card company have never been in touch since i told them about it
