Orange data usage charges

Morning all, i was wondering if someone might be able to help me shed some light on an issue. I'm not a frequent phone user so my old Orange EQ Virgin tariff was fine. The problem is OVP is a dead plan and has been for very many years. As such it's frozen at the point it was discontinued (back in 2004/5 I think). So the price matching would be based on the costs and services available then?

It would be very interesting to see how a court viewed this, but I think you'd find the costs to test it on the steep side! Even more so if they found in favour of Orange.
