    It was in the County Court but your right it does need to be High Court for it to set a precedent as legaly binding ...it won't stop others using it for referance for a ruling though. :rotfl:

    Most mobile networks allow you to cancel straight away if you find you have a signal issue although most are 7 days some are 14 and 28 ...interestingly 3 don't set a time limit so the OP's result is no surprise anyway;)

    After a discussion in store at three I came home with what I thought would be an easy phone for me. After trying to use it for a week I admitted defeat, My fingers r far too large for the touchscreen keys, It took me forever to send a txt, which usually was txt bk saying " what was that? cant understand". Very frustrating. Anyway I took phone back and explained, they said if nothing was wrong with phone they cant change it, it would be up to the manager. He said no as there was same phone on display I should have known before purchasing it. No use explaining to him that the assistant was really under pressure that day therefore didnt have time to spend showing me, it was all done very quickly. I am now left with a phone for two years, I cannot use. I said surely their was 14 days to change your mind ect. They said no, if I'd done it online with three then |I would have as I couldnt hold the phone on screen. I have always worked this way but this time on three you must go to a store for an upgrade, therefore I couldnt do my usual way of upgrading. Is there anything I can do? I have tried all the help pages but they say to go to the store!!!! I am going to have to pay £30 per month for two years and cant use the phone. I only took this out 7days ago. Please help?

    why not sell the phone on ebay? and keep the sim card.
    then purchase a new phone you like, and get on with??? i think this will be the best option imo

    they are not entitled to take the phone back from you. at the end of the day you chose it, and there is nothing wrong with it unfortunately.

    I had thought of that too but thought maybe I could have cancelled my contract within 14 days or something. thanks for answering anyway...
