Ooh forgot to mention they finally signed for prove it letter yesterday.
    Relieved!!

So, they phoned you after they got your letter? Report them. To the OFT, the Financial Ombudsman Service, and Consumer Direct.

Draft up the text for the first complaint, and keep a copy saved to use it for the other two - saves time that way.

    Cheers Fermi.
I was getting worried they may take action quicker as they'd received nothing from my husband.

    They can't take any action.

I feel a bit better now. I was awake till 3.30 this morning, not on purpose I might add, reading numerous forums with other peoples problems with this shower.

Again, they're scum. Dregs of society.

I was in tears as some of the posts where they've scared the life out people, any lengths I see they go to ignoring all laws, scandalous.

Now I'm in the know about these things, I wind such companies up for sport. One thing they particularly hate is bad back stories coming back on them.

I once asked MH that if they could prove the account, would they prefer to be paid in doughnuts? That didn't go down well with the caller.

I also noted that these people subscribe to these forums to get info! That spooked me. .

Which is why it pays never to include information that can personally identify you (account numbers, barcodes, reference numbers, and the like).

Why are these people still trading? Surely they've done enough up to now? I can honestly say if it was a member of the general public acting in this way, I'm sure they'd have been in trouble by now.......it's so not fair in my opinion.

That's being looked into at the moment - there's HFO Capital, and HFO Services. And it ties in with the legality of debt assignments. There's quite a bit of info out there about that.

FTW, no they didn't call after they received the letter, I was getting worried as I sent it on Monday and up to Thursday it hadn't been signed for. They have not called since.
As for the credit searches, I know it looks bad if another lender was to look and could think this person is involved with a DCA. I have done a bit of research, and from what I have read, I can get the credit reference agencies to remove them. I'll look into that when all this is hopefully over.
Bottleofred did ask me in an earlier post to see if there is any credit history from welcome on the credit file. There is nothing. Do you think that could possibly mean the debt could be statute barred?

I really don't dount that it is statute barred, but more than that, it wasn't real in the first place.

If it's not SB then why don't Welcome have the books still? And if it's not SB why is it not on the credit file? And if it's not SB why are HFO being so aggressive?

I'd bet you my last Rolo that it's not a legal debt at all, let alone a legally enforcible one. Keep your cool, it's what the DCA's dearly hope you wont do. They need you to flip out to get money out of you.

Think about a thug in a pub. If he sizes up the opposition and realises he's got no hope then he absolutely has to win the pre-fight banter. He's got to intimidate the other guy verbally so that the fight doesn't happen. This is exactly what HFO are doing to you. They know they have no legs, that the debt is probably not even real and if my some fluke it were even real, it's not enforcible, which means they have nothing. So they have to win the banter, they have to intimidate you.

Please please do not allow them to make you think they can do something to you. The intimidation they have unleased on you actually proves the opposite of what it's designed to make you believe. It very clearly indicates that they can't take action, they can't hurt you.

All they can do is what they are already doing, they can harass you, frighten you, lie to you, shout at you... Do not let them. When you take the scare out of DCA's they are powerless. Honestly, they are. You and I have as much power as a DCA does.

Even if by some absolute fluke you did really owe this and it wasn't statute barred and therefore they could take you to court they STILL wouldn't get anywhere because you've asked them to prove it and they have not. The burden is on them to prove you owe it, not you to prove you don't.

I had a nervous breakdown because of DCA's like this and because I didn't know then what I know now. What they said/did to me was evil too. Change your number, it's free most of the time. If you do that though you have to make sure the new one doesn't end up on your credit file so tell none of your creditors or even your bank. Phone numbers were probably what the trained HFO vampire bats were looking for as they flew on through your credit file last time. I know it sounds like a big deal but it really is so much less of a big deal than letting them emotionally assault you like this. Do not let the b*st*rds grind you down.

Stay calm. No matter which possibility you consider, they still have nothing. Get a number change, you can't be expected to live with this.
I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
(Ok, one of them is powerless, spiders can be nasty.)

As of the last count I have cleared
    [STRIKE]23.16%[/STRIKE] 22.49% of my debt. :(

A lot of excellent points there. Offers food for thought.

The line 'I'd bet you my last Rolo that it's not a legal debt at all, let alone a legally enforcible one.' being a very good one. That ties in with what I said before about debt assignments, and HFO Services/HFO Capital.

Thanks for the vote of confidence Hannah, you sound like you obviously know what you're talking about having been in this situation yourself. I'm sure you'll agree it is really easy to read about how to deal with them, but saying and doing are two totally different things. I understand that I can fight these people, and I will not let my husband pay for a debt which was cleared years ago, which is what he was going to do until I searched the net, but I still get worried, I can't help it, that's just me. I wish I'd have known I could have done something with the original DCA when welcome refused to pay the shortfall insurance, my husband payed extra for that protection and they wouldn't cough up............still you learn!!

I am logging the calls and not answering if I know it's them calling, and will be making every complaint I can about these idiots.
I'll update if there are any developments.

Can I just say a massive thanks to everyone for all of your help and support.
