help!tax credits have paid my ctc into an overdrawn account

similiar situation with me.
had jsa into my account on a thursday and i also had 3 lots of bank charges. rang the bank to inform them I would not have any monies for 2 weeks and they cancelled the charges.:A Tomorrow's just another day - keep smiling0 -
It is not Tax Credits fault . The banks take between 3/5 working days to credit an account once the money leaves the DWP or IR . If anything blame the banks and NOT Tax Credits . Also if you are O/D in your account , is that really Tax Credits fault ??? we all have to manage our own money .0

As a MOney Adviser I have used this to get HB back for a client. You may need to go higher than the person on the phone, the first person I spoke to didn't know what I was talking about but managed to go higher and my client managed to go into her local branch and withdraw all her benefit money.
Make sure you sound confident on the phone so write down a brief script, if you keep umming and ahhing they are going to know you are not sure and try and play on your ignorance of the regulation.

Thank you Eager_Elephant. My bank has just take £60 off when my benefits went in due to unpaid derect debit. Will try on monday with this information and see if I can get the money bank.0

your payment was due on wednesday 22 nov yes?
this would have left tax credits on the monday 20 nov at the very latest perhaps even friday/saturday the week before.
if your partner phoned on the friday, as i mentioned before CoC'S (change in circs) take min 48hrs to process,the original pmt will still have gone into the old acct.
this is not Tax credits fault.
once pmt has been released to the bank (which ever one it is) we cannot take it back. the bank either has to refuse it as the account is closed or invalid and return it to us.
if the account is still open or "underfunded", banks are banks and will accept the money as you owe them money and they will get it back anyway they can.fatblokexl:EasterBun:0 -
I'd just like to inform anyone who it may be of help to, i work for DWP, if you give them new bank details, it takes 4 days to apply, that however includes the day you notify us. (i count it as 3 days) i.e. if your benefits get paid on a Thursday you need to notify them on a Monday in order to have the Thursdays money into the new account.
There is no 48hrs needed to action these new bank details, as they should/can be changed by the person who answers the phone.
It is advisable to ring before 3pm.
BUT.........not many people know this, if you are too late to have your payment put into your new bank account WE CAN RECALL IT!
We may not broadcast this point, but WE CAN RECALL A PAYMENT UPTO 10 DAYS AFTER IT HAS BEEN PAID.
You may need to specifically ask for this option, but if they refuse, ask to speak to a manager.
Be warned though, it can take upto 10days for the payment to get back to us, but you can in the meantime ask for a crisis loan, you can ask for one of these at your local job centre or social security office. You cannot however, ask for this over the phone. For 1 you need to sign for it & 2 you are given a giro there & then, to cash at a post office of your choice.
You can also ask for a giro if you think your benefits have not got time to go into your new bank account, this can be issued to you upto the day before your benefits are due to go into your current bank account, as it is much easier to cancel a bank payment (BACS) before it actually reaches the account than it is afterwards. This request can be made by telephone.

Hi all, after flicking through the posts on here i noticed something alarming. Although my husband works, i get benefit as i am unable to work, i get incapacity benefit, child benefit and childs tax credit. All of which go into my account, infact, its the only way me bank gets credited.
So after reading this thread, i phoned my bank ( HALIFAX) and spoke to a great guy in their dept that deals with charges. After explaining to him and also reading out the Social security administartion act 1992, sect 187a,b,c he totally agreed with what i was saying.
He advised me, in a very nice way, to pop into branch with a letter, stating the above and basically ask in the letter that all charges that have been placed on my account be refunded. I have only had the account since may 03, but he said that he couldnt check them personally, but he will request all my statements from my opening date for free so it will ensure that i get the full amount possible. I have to say, it was a breathe of fresh air to talk to someone who was WILLING AND GENUINELY trying to help. I have done the letter, printed off the above act, highlighted it and will be going to my local branch to hand it in. The letter simply states ' all charges made to my account since 18/5/2003' i know that since may 05 they have charged me 6 lots of 39 pounds. I will keep you all posted as to how it went. I think there may be a few more, but will wait for them to send the statements out.
If however this line of fire doesnt work, i will go ahead with the same route that everyone else is doing, ie threatening to take them to court etc. My other half is a solicitor, so i will be alright!! ( i wont need to get a solicitor, hehe)
Thank you all so much for shedding light onto this, i HATE HALIFAX with a passion and will be moving accounts once it has been dealt with.

Can i fone my bank and get them to credit my account with the charge they took out on wed (£100 all of my benefit) i can even get money out to get gas on.savings for 2012.. New year new me.. Going to save save save... and not spend spend spend. :rotfl:
