.....an item turns up totally not as described! :mad:
I bought a dress which was SUPPOSEDLY Brand New without tags. It turns up today, creased to death, reeking of fags and the label inside the dress is filthy! I wouldn't mind, but i paid a fair amount for this dress and it turns out to be see thru! No mention of that in the flippin' auction!
I've just had a root thru their feedback only to find previous comments about the smoke smell and about used dresses being sent instead of new. (Not negs btw, in pos's!) Here's how the seller responds to feedback:
"IMPOSSIBLE FOR ANY ITEM TO SMELL OF SMOKE AS DESPATCHED FROM NON SMOKING STORAGE. ITEM NEW"
Hmm, well i beg to differ. I want the seller to have a whiff of the dress they sent me and check out the riffy tag,
I've emailed the seller with my complaints in a very pleasant manner, but will i receive a reply? Time will tell.
UPDATE: Well i received this from the seller:
Hi,
Thank you for your email, all our items are new and are purchased from a warehouse supplier, if you look on ebay at the moment we have 24 of the exact same dress for sale. The dress is not see though. No items smell of smoke as they are despatch from non smoking storage unit - with exception of the 1st negative item on my feedback as that was despatch by a smoking employee. Please feel free to leave whatever feedback that you find appropriate as i clearly state on my bids no returns or refunds
What shall i do now? The seller is effectively calling me a liar, when in fact its the SELLER that is a liar!
By law the one thing a seller is required to do is describe the item accurately. Where the hell do i go from here
. Why would i make it up! Besides, i'm not the only person to complain about this judging by their feedback.
I'm going to file a complaint with eBay but i can't do that until the 28th Feb. I am also filing a complaint with Paypal. No point contacting the seller again, its blatantly obvious they don't want to know.
Times like this, eBaying is rubbish

What is the sellers return policy? if they have one, otherwise maybe you will need to speak to your local trading standards.ummm...0

The seller does state no returns or refunds. However, as i said, by law private sellers are required to accurately describe their goods.

also if they have more than one of the same item they are operating as a business. this means that they have to offer refund under distance selling regs, this gives you 7days to request refund from date of getting the item. It does not matter if they say that they do not offer refunds, they have no choice. the distance seleling regs cover ebay sales items from a business. trading standards can investigate or if you paid by paypal do charge back0

Yes do a chargeback through paypal if you can and then ask the seller if they want the dress back as you have withdrawn your money.
Thats what I would do.Id also photograph the state of the dress flat and against the light to prove it was not as described and save their description alongside it to send to trading standards if they want to get stroppy about things. Pity you cant save the smell too.

I have posted on another board as I am a novice at this and I didn't know which to post on. I have a complaint with an eBay regular seller and I would like to name and shame them on here at least. I have found a site which gives you all the negative and neutral feedback and there are loads about this seller which I didn't realise before. What can I do when they won't refund?0
