Section 75

Recently we booked a weekend away to london and also bought theatre tickets which was for four of us the total coming to just short of £300, today i have found out that the company has gone bust and my tickets were never actually paid for by the company. I paid for them on my visa card but when i phoned the bank company up to see if i was covered with my visa they said it was unlikely that i was covered and probably would not be able to make a claim to get my money back is this true and what should i do

    Call centre drones often get this piece of legislation wrong - credit card companies are jointly liable for the provision of goods and services over £100 with the company you buy from. So yes, you are covered (assuming each transaction was over £100).

    I'd suggest you look up the specific wording on the legislation online, call them back and try again. If that gets you nowhere, put it in writing.

    OP, was it a Visa debit or credit card? How long ago did you book? When you say that the company has gone bust, has there been a receiver/ administrator appointed to manage the company affairs?

  • it was credit card visa, we booked on 15th january and it went into recievership on 25th of feb but we have just found out today after seeing it in local paper

    If the tickets cost more than £100 you should have a case.

    The facts are correct - if it's on a credit card and the transaction is over £100, it should be covered.

    I've claimed this cover twice from two different banks - both times it was very difficult to get them to accept liability. The people in the call centres knew nothing about it and couldn't deviate from the script.

    OP - try getting through to a supervisor, they usually have more authority to deal with this kind of thing. I'd suggest putting it in writing too, that usually got more traction in my experience.

    Hopefully the whole lot (including the accomodation...it's still not really clear from either of the OP's posts whether everything was purchased from the same supplier) was 'packaged' and invoiced as a job lot.

    I've never used section 75 but would that work?

    Alternatively, how about Visa chargeback?

    Visa chargeback for non receipt of tickets should be the first option, chargeback can only be actioned after the date of the event unless you have a letter from the administrator/liquidator stating that you won't receive your tickets. If you have then a chargeback can be done straight away. Section 75 would only be valid if each individual ticket was more than £100 (if it's not a package deal)
