Cold water tank querie

Hi we live in the upstairs flat and have a combi boiler were all our water comes direct from the mains. I am wondering what would happen if the cold water storage tank burst who would be responsible for the damages caused would it be our insurance or downstair neighbours insurance since they have full use off this Cold water tank which is in our attic. If this was to burst fingers crossed it dosent can we refuse to have it replaced back in our attic ?

Looking for an answer to this...

    On refusing to have the cold water tank replaced, the answer will be in the deeds of the properties. It would, I suggest, be almost certain that you couldn't take any action to deprive the downstairs flat of any facilities. Is all your water - to toilets, taps etc on the mains water supply?

    It is possible that your electricity cables? water pipes? gas pipes? telephone lines? pass through the walls of the downstairs flat. If that is the case they wouldn't be allowed to interfere with those facilities.

    On insurance, whose insurance covers the roof and other 'common parts'?
  • Hi I have checked the title deeds and it does not mention the cold water tank at all anywere in them , As for the roof its split 50/50, we do not use the cold water tank at all as we have a combi boiler so all our water comes direct from the mains we do not have any use off the cold water tank with any taps, toilets etc etc

    Down stairs have refused to put in a combi boiler as they will loose a cupboard and they want to keep there back boiler as long as possible, So who is responsible for the up keep off this tank with the jackets etc ? So I guess from what your saying it will have to come direct from our own house insurance if there was to be a problem with this tank which we dont use or have any use of so if this was the case I can refuse another one to be fitted then? as its in my attic. Gas comes up the outside wall, Telephone direct from pole to the house , Water main comes up inside the wall,

    Would I be better to call my house insurance direct ? Or the mortgage company to ask were I stand on this matter?

    What's the position regarding leases? Are you both free holders or both lease holders or one freehold one lease hold? Who insures the building

    If you're both lease holders and there is a free holder somewhere, it would be a question for them I would think.

    If you're both free hold you could inspect the condition of the tank and fittings. Tell downstairs in writing if anything looks a bit dodgy and that you'd be claiming from them should there be any leaks.
  • Hi both house's are on mortages , I think I may phone the insurance company to find out about this, I have insurance for my own house and I would think downstairs will be the same with there own building insurances, The tank is an old tin looking thing I have no idea how old it is but I would say its old by the looks of it.
