carphone warehouse - blackberry

hello everyone (im new to the site btw)

anyway... just under a year ago i bought a blackberry from carphone warehouse on payg.

Long story short... its broke several times and each time they have taken the phone off me and replaced it with another (the last time being only a month ago and it has broke again in the space of a month.)

The fault with the phone has always been hardware etc i havent dropped it or anything like that. When my phone has been replaced it has been with a re-conditioned one and they are crap basically and this is why after a month it has broken again.

where do i stand? can i demand a brand new phone?
also i have been told that if a product you buy is faulty through no fault of your own then you can demand the travel costs but they wont let me have them either? am i just being fobbed off or do i not have a leg to stand on with anything here?

any help would be greatly appreciated

    Legally they have to offer you a repair or replacement or a similar phone. As long as they do so (and it sounds like they have) they are covered. Customer goodwill is another matter and not written in law.

    Remember the phone you took in was not new, that was used too albiet by you.

    In terms of costs it's down to you to get it to a "service location" be that there shop, sending it to there workshop etc so you don;'t really have any legal grounds to do anything.

    However an politely worded email to the executive office email adddress or a director may get you better results than in store.
