I have been with VM since about 2001, I recently appied for a mobile phone and failed the credit check! I then applied for my credit report and everything is good, I even spoke to equifax and they said there is no reason as to why they refused me. I then had a phone call from virgin saying I owe £940:shocked: from the year 2001. They wont give me any details as to the dates or how this debt came to be. I know I do not owe this money and this is the first I have heard of it. Surley if i did owe then they would have reffered it to a credit agency by now. I am getting no where with virgin and to be honest they can stuff their phone but I want this sorted out. Btw I have T.V Internet and phone plus I get a loyalty bonus.

    Virgin is probably the most messy mobile company around.
    Apparently, Experain even refused to list data held by them: Virgin Mobile\Equifax Credit Checks

    Don't waste your time on speaking to them over a phone. Complain in writing.

    Pay it if they prove that you do owe them.
    Complain if they claim that you owe, but refuse to prove it.
    In the worst case scenario you can request all the data they held on you under the DPA. I think this will cost you £10.

    I think there is an act or law regarding old debts.

    If it is over 6 years old and they have never asked you for it back, I think you can refuse to pay it back.

    I am sure someone on this site will be able to give you the correct advice about it though!

    Even so, if it was me I would want to know why they had a debt against me in the first place and would be chasing it up.

    By any chance could the debt be on against your property? When I moved into my house, the previous occupants had run up a bill of about £500 with Virgin, then when I first tried to apply for account with them, they said my property was a high risk and I would have to pay a £100 deposit which would not be returned for 12 months!!

    Definatly no debt when I moved in as it was my fathers house, and he only ever had BT and Sky t.v. I have phoned them but they say that all that is showing is the amount owed and account 01. no-one seems to know what this means and they have no other info because it is such a long time ago they say they don't have it on their system any more! They have never mentioned this debt until now and I have always paid my account in full by DD.I just don't get what is going on! As I said equifax said that they would have got the same info as I have and there is no indication of a late payment to anyone let alone a debt of this size.

    How do I get them to prove this debt. All they say is that they have no other info apart from £940 owing account 01. They say because it is so old they don't have any other info on their system.

    If they cannot prove it ask them to remove this record. If they refuse, complain.

    Hi daff,
    As it is well over 6 years since 2001 it is now satute barrred so they are unable to chase you for the money.

    It would only be current if you had paid an amount of the debt within the last 6 years so as you were unaware of any debt I doubt that would be the case ;)

    Most companies these day only keep records for the minimum requirements (6 years) so prob would not be able to supply details anyway.

    I would forget about it and them but if you were to drop them a line and explain that as both you and them have no record of any debt and even so would be statute barred could they please rectify their records etc etc

    I would still chase them up on it though and try get them to find out what it is, and also get them to remove it.
