Part-ex fallback scheme help????

We are looking at a new build with persimmon homes and have agreed a fall back part ex on our home. When "mr persimmon" came out to explain it all he sold it as a guaranteed part ex. Now the same person is saying the plot is only reserved for 6 weeks and after that if another buyer comes along in a better position basically we lose out! Oh and by the way we keep half your deposit:mad: I have argued the case back and forth saying that they didnt tell us this and said initially that week to week the sale of our house would be monitored and if they sold it as a loss then their loss it would be.
I just wondered if anybody had any experience or knowledge and could help me out please

sorry but i wouldn't touch persimmon homes with a bargepole!!!
last year we decided to buy a new build with them and got what we though was a great deal they even offered us part exchanged plus which meant we could move and they'd sell our property for us we didn't have to wait and find a buyer ourselves so we paid our £500 deposit and hoped to be in our new home in approx a month like they said, we arn't naive and didn't expect it to be that quick but we expected it to all go swimmingly as they'd promised.
a few weeks later they went back on their offer of part-exchange plus saying we would have to sell the property first which we weren't happy about but within a few days we had a buyer, but they messed us about so much and asked so much and changed this that and the other that we got so sick of being messed about we had no option but to pull out losing our deposit and the buyer on our home because they could only afford to buy it at the discounted price that persimmon were marketting it at and not the price they'd offered to buy it off us which was about £14,000 difference.0 -
Thanks for that - i have heard several stories similar not all persimmon, but barratts etc too im just wondering where we stand from a legal point really as we have paid the deposit etc did you just accept the loss of deposit or did you try and get it back?
I just think 6 weeks is a very short time given the climate to sell any house. I even went in to see them at the site today and was still told that after 6 weeks its taken week to week and one has never fallen through yet on here etc etc
the stress is already getting unbearable, whats the point of part ex if its not guaranteed!:mad:0 -

But while the housing market is soooo poor it seems more and more people are opting for part ex to enable a move, it just seems there isnt much control over what goes on which is very frustrating!0

we did try to get our deposit back from them saying they were the ones that went back on the offer but they turned us down flat, we have contacted them again but they chose not to reply. . .nice huh!! we thought about going through solicitor but it would probably cost us a fortune in solicitors fees so its not worth the hassle, we have however been told we may be able to get it back through credit card company and them then pursue it as it was them who went back on their word but think its a long shot0

Good luck with getting it back we were just saying that we would do the same thing if it all goes pear shaped.
Its complete miss selling as far as im concerned, a nice letter to trading standards may be order0 -

Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should
If you are trying to buy your first house its almost impossible.0 -
thanks geoff hadn't considered that will look into it, we didn't contact trading standards but we did contact an organisation similar but for the building trade (not sure off-hand off the name sorry) but they weren't much help and advised us to let our solicitor deal with it all0

Well well, This is a terribly familiar story.
My heart goes out to all of you who have suffered at the hands of Persimmon.
We are currently in the same position.
They have gone back on a Part Exchange Plus Deal after 4 months and changed it to a 6 week easymover scheme, (expires 31st July).
Our main problem was buying off plan, therefore too much time for them to sit around and think.
Persimmon's big problem was that they bit off more than they could chew, taking on all these Part Ex properties & then getting stuck with them.
Their cashflow situation isn't good and they have made a lot of redundancies, this could be a sign they are are on the rocks! With that in mind, we may have all had a lucky escape!
Despite this though, we have started a campaign to either get our house or a full refund for all the money they have had off us and the needless extra work our solicitor had to do because they were just using delaying tactics to prevent exchange of contracts. About £1k they owe us.

I don't know which solicitors you guys used, but we made the mistake of using the ones recommended by Persimmon ( as they offer a financial incentive for doing this).
This has backfired as all is good until you get a dispute, then your Solicitor is too scared to take any action in case he loses business.
That should prompt another debate on referal fees!
Trading Standards and consumer direct will not get involved with property, so we have ended up at the Office of Fair Trading & they are looking at this case at the moment.
When I asked the area MD for our development how many of these deals had been pulled, he said just ours and one other.
From what I can see here it is clearly a bigger problem.
I would like to invite anyone who has suffered from Persimmon's shady business practices to contact me so I can build up a picture of exactly how many have been affected.
I intend to pursue this to the bitter end and the more voices we have the better.
They have already warned me to stay away from the press or else I wont get any money back! They say that the amount of bad publicity they get will not affect them and if anything they thrive on it!! I am gobsmacked at their arrogance.
