  • Dave, my husband assures me he has had not contact from the companies and he will be sending one of the letters we have downloaded to them.

    You are so right, they employ dirty, bullyish tactics to get people to pay when really they do not have to as many are unaware of this statute barred thing.

    We didn't know about it. I only 'stummbled' across it when I googled the company and these threads come up about it and this website.

    Hopefully we will have some news soon, but I am not holding my breathe cos as I have read that they do not reply that well to letters!

    Hope this isn't too late but make sure you send the letter either special delivery or recorded that way they cannot deny receiving it as they will more than likely try to in the future. good luck and you have been given correct advice it is statued barred they can do NOTHING at all.
  • As I have mentioned elsewhere it works both ways - interesting that on the few occasions when I make a negative comment about someone I get jumped on by the multitude but rog2 is quite free to say what he likes about who he likes as often as he likes - double standards applying here I think !! Also very interesting that he hasn't been able to respond to my post No. 26 - he can dish it out but can't take it.

    The problem is Troll that if my memory serves me right you are a debt collecter who works for a DCA who always posts in favour of debt collection agency's :)

    If hubby is in the job ( i'm ex job) he does need to tread a bit careful but in honesty if MH spoke tto the Police about his current financial situation then they would be in vreach of the DPA so it is highly unlikely that they will. Send the letter. If i were he i would also go speak to the welfare officer just so that he can say he isn't avoiding the debt merely trying to deal with the issue and exercising his rights as can every other citizen.

    MH and the like are parasites they make millions of people's lives a misery despite them trying to sort their lives out. if they are prepared to spend money on old debts they know legally they can't collect then thats their look out. They are about as moral as a bishop at a wife swapping party!

    And presumably you have evidence they are trying to sort their lives out. And just how have they done this after ignoring a debt for over 6 years ?

    Like many you don't understand - there is nothing wrong legally with writing to a debtor about a debt that is more than 6 years old. The only time it becomes an issue is if the debtor then writes back stating they will not pay it as it is now statute barred and MH continue to chase the debt. Has there been any evidence that this has happened ? NO ! I would check up on your understanding of the law - might be useful in your job.

    They rely on the fact that not many people are aware of the 'Statute Barred' legislation.     CORRECT - but I am not alone - the Kilmarnock Trading Standards Office are also keeping a close eye on the activities of these people.
    Do exactly as File_Wizard says - THEY CAN DO NOTHING.

    10 months ago, i recieved a letter from these people, and apparently the debt was from 14 years ago when i first got married. so i phoned the company has i was concerned, it was for £200, told the guy on the phone that i knew nothing of it, which i honestly didnt, didnt get into debt when we first got married, i panicked and ended up paying them, from this day i still dont know who or what the debt was from.

    Sorry to confuse you - it was a statement made earlier in this thread, because I believe that it is wrong that DCA's like Mackenzie Hall play on the fact that most people are unaware of their rights. If you had known about the 'statute barred' legislation, you would not have had to give these 'thugs' £200 of your money.

  • thanks, so really i shouldnt of paid them especially a debt after 14 years, i honestly didnt know anything about, i should claim it back from them laugh!

    Might be an interesting thought - although probably more hassle than it would be worth. You could reprt them to the Kilmarnock Trading Standards department if they were at all nasty though.:beer:
