The offer of monthly payement was a verbal suggestion and NOT in writting. As far as we are aware the call was not recorded. Dave was aware ofr the date as they told him the debt dated back to 1997. Nothing has been in writting until not.
They called yesterday and again today. Fave said he will not be getting into conversation with them regarding this matter and that he has sent them a letter detailing this and further correspondance should be made in writting to him. They said why and he said he strongly believes it comes under the statue barred. He promptly ended the conversation after they had said despite that they can still persue taking Dave to court.
I think it is alot of threats and manipulation as they have a;ready told him he could get fired if the police force finds out he has been avoiding such debt. He them police regulations states nothing of the sort and you can only not hold such a position if you are bankrupt. That out them straight!
Letter is on its way to them so we are now awaiting their response. I gather it probably will be threats and sorts by telephone of which we will not get into conversation with them and if need be put the phone down on them.

If your husband is in the job he should be conversant with both the protection from harassment act, and maybe the administration of justice act.
The Administration of Justice Act 1970.
Section 40 of the act provides that a person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under contract, he or she:
(a) harasses the other with demands for payment which by their frequency, or the manner or occasion of their making, or any accompanying threat or publicity are calculated to subject him or his family or household to alarm, distress or humiliation;
(b) falsely represents, in relation to the money claimed, that criminal proceedings lie for failure to pay it;
(c) falsely represent themselves to be authorised in some official capacity to claim or enforce payment;
(d) utters a document falsely represented by him to have some official character or purporting to have some official character which he knows it has not.
If they continue to contact you in this manner after you have officialy informed them that the debt is statute barred then they commit a criminal offence under both acts.:rolleyes: It’s hard enough remembering my opinions - without remembering my reasons for them :rolleyes:0 -
Thanks file wizzard. He will be persuing such things if they continue to harass him after the writeen letter to them.
He will not stand for bad behaviour by this company and we will do our best to bring justice from this and hopefully nail MH! And we will be smiling!0 -

Chancing their arm ?? Actually they are perfectly entitled to ask for payment and there is nothing wrong with that. You routinely state it is against OFT gudelines to do this when it definately is not. It only becomes an issue AFTER a letter has been sent to them stating you will not pay and they continue to chase you. Remember not everyone has your low sense of morals and some people would quite like to pay back what they owe even if it is after 6 years.0 -

Lets Face It I Cleared My Debts I Was Given Rebates Etc Early Settlement Figures Etc, But As My Accountant Friend Said They Had Made There Money BACK AND PLENTY MORE From Charges Etc And I In Most Of The Cases Had Paid My Loans And More And Then A Dca Bought Two Of My Debts I Paid Them Off To All With Large Charges Attached I Now Have Taken Two Companies To Court For 3k In Total What My Accountant States To Be Over Payment And I Will Let My Solicitor Meet Them In Court0

Tootsie roll - we do not have low morals and disagree with your general statement you made. My husband genuinely thought his ex had paid this off hence why he didnt change details of address etc etc as it was the ex who had dealt with all of this. Or so we thought until this week - 9 yrs kater!!
we are descent hard working people and like many something has creeped up from the past. Not that anyone has hidden form it or refuses to pay for it. He would be willing to pay for debt and I am paying my 12K. But there are laws to help protect people like us like the statuted barred thing and if that is so we are not going to be daft and so oh never mind we will still pay anyway. Noone in their right mind would even if they are the most honourable and hardworking person on this planet.
Please refrain from using such offensive and generalised statements as this as there are alot of people on this board in whom you could offend - me excluded.0
